Because Alabama failed to bring the correct argument which is what Kavanaugh wrote in the final paragraph in his concurring opinion. Kavanaugh stated that AL did not directly challenge Section 2 of the VRA. However, Louisiana is going to do that.

A primary challenge is needed to remove Landry and Murrill. They have betrayed the GOP once again.
How ironic that Louisiana went from challenging Section 2 of the VRA to defending it. SCOTUS may take up this question as Louisiana outlines it, which could get very interesting.
