If you want to use art, ask permission/pay for it. If you don't do that and scrape into a GenAI engine and it trashes your dataset; well, actions have consequences. Don't want your dataset trashed? Then be ethical and pay for data. It's your choice.
Photoshop takes skill to learn how to use correctly. The issues with use came later when you became able to create scenes in photoshop that competed with doing real life shoots, also the ideas of altering reality etc were and still are on some levels a discussion.
