First part of trying to get my works removed from LAION datasets is to ask the researcher directly ( @Rom1504 ). I told them that my work is on the Internet "unlawfully" (stolen by a games firm) & is thus not subject to any TDM exceptions. A reasonable request by any standard!

Someone explain to me; Stability are offering "opt out" of their AI system but work of @kortizart is clearly in Stability's training data as ANYONE can see. Given Stability are facing legal action, why haven't they "opted out" Karla's work?! She clearly doesn't want it in there!

This is important! If AI is "fair use"; the whole US creative economy will lose trillions in licensing revenue. e.g. It would allow foreign firms like Nintendo to raid the IP of Disney, Marvel et al to make competing works FOR FREE at an exponential level.

@DarrylMason I stopped film producers using my work for a sequel and a whole franchise. That's why my work is not in the sequel. ;) Producers went bankrupt and 2 million in debt. 3rd film got shelved. Disney can't take my work either. (Not that they would want it)

Netflix may put money up front for production but studios take their cut before the production starts as they won't benefit from net profits through distribution. They keep wages low as a result. It's a corrupt system.

Unsurprising, but welcome. As a doctrinal matter, copyright can't protect AI output, because it's impossible for a person to contribute an original element when they can't know in advance what the machine will produce in response to their prompt.

See US17 §103a & US©O circular 14 plus Anderson v Stallone. Publishing platforms would also lose their safeharbour under DMCA laws.

6/ Similar to Margret Keane (Big Eyes case), I had to demonstrate to the judge I could do 3D animation work using my Iron Sky work. The judge believed me and got very angry with Troll VFX. I won the case and had all my Iron sky work back....Troll VFX appealed. It got crazier.

@AnTimNguyen @Saihtamen Also useful. Make the client understand that copyright doesn't belong to the commissioning party. Put it another way, the client won't get copyright even if they paid for the commissioned service. Needs separate payment for exclusive license or assignment.

@franklingraves Well here is the addmition from Kashtanova that using AI images gens really isn't authorship. It's just random generations that one has very little control over. Eventually you just have to settle for what it produces. That's not authorship.

4/ My work had already been sold to a games company in Poland to make the game Iron Sky Invasion. I was bemused by it all. The games company were even sending me messages to ask for help with the files.... I told them I was taking legal action!

2/ After Iron Sky was released in 2012 the production company formed a new company Troll VFX. They paid me minimum wage. I found out everyone else (Finns) were getting paid more AND there were plans for Iron Sky 2. I'm from UK.

24/ Financial statements confirm investor's money was being funneled elsewhere. 200K to owner of Troll VFX. True cost of IS2 was 6 million. Chinese film never came out. Producers bankrupt owing 2 million. I walked away with all my work including IPR to use in future stuff I do.

3/ I pointed out to producers that I still owned all the IPR for my work on Iron Sky and asked for a salary review.....I was immediately sacked! They were trying to steal my work and Troll VFX owner had already made a €200K deal for my IPR.

26/The Producer's and director were defrauding crowdfunding fans because they didn't own any © to make a sequel. I had 4 court cases where producers claimed I was an "intern" & couldn't do 3D work. They just lied. I'm top of the list of VFX artists in credits

10/ However, the producers didn't actually own the rights to make any franchise. I had won my case against Troll VFX and had all the 3D artwork. I contacted Pixomondo and told them this. Same with NBC Universal and the Chinese producers. The "chain of title" was broken.

17/ Eventually, I found some lawyers to help. They understood everything. One was even an ex judge. We got a filing together and news broke in the Hollywood Reporter. Woo-hoo! The shit hit the fan for Iron Sky Producers. They were told by distributors to get things sorted.

5/ I was an ERTO union member. They sued Troll VFX for discrimination & unfair dismissal. Then things got crazy. Troll VFX claimed I wasn't a 3D artist in court and had never worked on Iron Sky. Even getting their friends & my work mates to testify I couldn't do 3D animation.

@emmaisafish @mspixieriot @morningwitchy The winner keeps © ownership proper of their work. The rules only mention a non exclusive license. An exclusive license requires a written agreement signed by both parties. There's no work for hire agreement either.

To help clarify some of the discourse on US©O guidelines: I've taken Kashtanova's AI outputs & made my own comic!! Similar to Kashtanova, I can only register elements on the right as human authorship (but not Mona Lisa or Naruto) . There's no © for the rest of the comic. :)

11/ All production plans were going to collapse If I owned IPR. 50Million in deals were on the table but couldn't be finalised if I still held the IPR to all the 3D work. It was all fraud. There couldn't be distribution without a "chain of title". Investors would lose money!!

16/ I tried a new tactic. To get Iron Sky Universe to sue me! I made a 3D print of the main Iron Sky UFO & started selling it. Got some friends to help making a VR prototype using Iron Sky Models. Demoed it at various places. ISU were watching, & gathering evidence...mwahahaha!
