Please stop and read this. It’s from the Republican-led bipartisan Senate Intel Report Volume 5. It’s important we recognize what is happening. It was a landmark report and many of the same actors are still active and engaged.
I don’t know what happened here but if
@elonmusk
doesn’t fix this within the hour with an explanation by morning, I’ll be on Capitol Hill tomorrow demanding that he be hauled in front of Congress.
In short, AOC says not to trust Facebook and consider sitting them out for 2020 as they’re clearly sitting out their own responsibilities to election integrity. I agree.
OK, whew. I've now read all 130 pages of state AGs suit v Google.
In three words, Google is royally screwed.
Expect...
Press headlines: Facebook and Google colluded!
Deeper dives: Google turned open web into a walled garden of tying, exclusionary tactics, and privacy fixing.
hot damn news!!! This just posted - Mark Zuckerberg and Sheryl Sandberg set to be deposed in a federal court (N. Cal) for first time regarding their Cambridge Analytica cover-up. This on top of the 13yrs of discovery of their messages and files which recently kickstarted. /1
Get this: in 2020, Donald Trump claimed he closed his foreign bank account in China before running in 2016. But Trump’s newly-released tax returns show he *did* hold foreign bank accounts in China in 2016 AND 2017. Trump lied to voters. And it’s about time he is held accountable.
ok, I've now read the full NYT complaint filed this morning vs OpenAI and Microsoft. I'm impressed - it's future-focused around fair value for work vital to democracy. It also contains 220k pages of exhibits although the pages of Ex J stood out to me. more on that in a minute. /1
!!! news. mother of all lawsuits quietly filed last month vs Facebook in Delaware. I'll explain why it avoided notice until now in a bit but Zuckerberg, Sandberg, CFO, board inc Peter Thiel and Palantir are defendants - it's a result of sealed docs between FB execs and board. /1
This is
@profgalloway
at his best. Straightforward, fearless candor splashed with industry, tech and life wisdom. Highly recommend, he nails it in two minutes.
What an embarrassment of a thread. So twitter’s ceo EM engineered an incredibly weak hit job using internal materials that show Twitter firewalls its safety decisions from its comms and lobbying departments (for good reason, unlike Facebook). Nice job, Musk fans. Meanwhile…1/3
Pro tip: if you own an iOS device, next week is likely to bring you the most significant improvement in digital privacy in the history of the internet. And it will kneecap Facebook. 🍿
I created this quick doc to track all journalist twitter accounts suspended tonight. Please reply to this thread with any I’m missing or any that are reinstated. 🙏🏽 THANKS.
!!! Friday Night Surprise. Plaintiffs just filed their response to Facebook in my favorite case - what I call the mother of all lawsuits - in Delaware where it's incorporated. It's a tight but absolutely delicious 120 pages so I'll break down the allegations here for you. /1
US Attorney General Merrick Garland made a remarkably powerful speech over the weekend after swearing in the newest citizens at Ellis Island. Threading it here with the highest recommendation (ten minutes!). I’ll play it for my own kids this evening. 1 of 5
If I was a reporter covering Facebook, I would be preparing for a very busy week. If I had internal sources at Facebook, I would be staying close to them. If I was an opinion desk or tv booker, I would be rejecting giving Facebook leadership access to my platform. That’s all.
The ban appears to be what we thought it was. An impulsive attempt to lash out against accurate reporting Elon Musk didn’t like. This is exactly the role of an independent press - to hold powerful and public officials to account. 1/2
hot damn news!!! the lawsuit for the cover up of Cambridge Analytica and Facebook's data leaky app platform just escalated. In a parallel case in DC, Zuckerberg was ordered for deposition last week. Pop some corn please.
I deflected conspiracies today but now change my position. If I were Facebook and knew these eight SEC whistleblower complaints were being published today, I sure as hell would take down my own apps to distract the press.
They are deadly - way beyond what we've seen so far. /1
ok, let's do this. I've now read all 153 pages of United States vs Google filed earlier today. As I've said earlier, Google is royally screwed.
The suit is super well-written building on prior work investigating Google’s market power abuse leveraging advertising technologies. /1
There was a remarkable 60 Minutes segment last night - shouldn’t be missed. Arizona Speaker of House Rusty Bowers and A.G. Mark Brnovich (both Republicans) with strong interviewing by Scott Pelley rightly using the words, “lies” and “scaremongering.” /1
Nice way to close the
@nbcsnl
cold open by Brad Pitt w a break from character, removal of wig and thank you to Dr. Fauci and all the frontline medical workers.
Department of Justice has now posted its hundreds of great slides from closing arguments. I’ll share 13 slides that tell story imho captured by this list.
First, if search defaults don’t matter, why pay approx $30B, 40% of revenue to maintain them? 1/13
Based on Zuckerberg answers to
@AOC
yesterday, we now know people on his leadership team knew about Cambridge Analytica scraping personal data prior to Dec 2015 Guardian report but we’re also supposed to believe Zuckerberg did NOT know until March 2018.
"Raskin said the committee will present "evidence" that proves there was coordination among then-President Donald Trump and his inner circle and his supporters who attacked the Capitol on Jan. 6 in an attempt to overturn the 2020 presidential election."
Finally. Here in SEC docs is what Facebook has painfully avoided public knowing and press has mostly missed documenting. Facebook data was ****SOLD**** to Cambridge Analytica. Can everyone please now say that Facebook personal data was sold rather than captured, transferred, etc?
Musk blamed the free and plural press (again) falsely for “collusion” (his word) without anything of substance in any of this thread. He’s an empty trust vessel at this point. 2/3
Whoa. Facebook had a secret "Project Ghostbusters" (get it?) which allegedly was to decrypt "man-in-the-middle" style Snapchat traffic to copy it. Yellow highlight indicates redactions just lifted in nine unsealed plaintiffs briefs in private antitrust lawsuit. Wild stuff. /1
Here is Musk’s full exchange on Twitter Space as he tried to explain himself, misrepresented what the reporter was doing, the reporter challenged him and then Musk misrepresented it again and took off.
HUGE!!! watch this in Germany. The court has now ruled Facebook has to stop collecting and using data *across* its apps (FB, Insta, WhatsApp) and broader web (millions of sites)...importantly due to its dominance/antitrust...while it awaits appeal of decision lost Feb 2019.
“We have no doubt that Facebook has a dominant market position on the social network market and that it misuses its position,” said presiding judge Peter Meier-Beck of the Federal Court of Justice in Karlsruhe.
Wow, the details in the Wash Post report on the Willard Hotel “war room” are eye-popping put together. So the Campaign funded a command center to strong arm state officials to falsely claim fraud, reverse a democratic election and incite an insurrection?
Woah. This is one of the more damning reports I’ve ever read on Facebook. Yes, that says something. It’s a deeply reported must-read on how Facebook’s political and PR interests affect public safety. A sick, sick company.
ok, it's started. if you're interested in Facebook accountability, you don't want to miss this. Judge already just told the plaintiffs to "file a motion for sanctions" because "Facebook's discovery conduct has been sanctionable." More coming... /1
I saw questions last night whether Parscale admittance to hospital related to NYT report. I would instead look across the Atlantic. This reporting in two hours can only lead to perjury charges for Parscale.
🚨🚨Tonight at 7pm:🚨🚨
EXCLUSIVE: Channel 4 News investigation reveals a huge Trump campaign data leak, exposing how 3.5 million Black Americans were listed as ‘Deterrence’ - to try to stop them voting in 2016.

“I hope Zuckerberg is in jail by then…this is an enemy of the United States of America. He doesn’t give a $&;! about us… it’s just about filthy lucre…and Sheryl [Sandberg] is a complicit.” - Ken Burns with a surprise unload on Facebook leadership midway in his Sway interview.
This chart shows Facebook's active fake account population is larger than the entire United States and would be the third largest country in the world. It's also one of the most critical platforms to the media economy for both advertisers and publishers.
Yet it's not audited.
Mark Zuckerberg has always said Facebook is a platform for authenticity. But phoney identities have reached a record high, a big problem for a company that trumpets user growth — a barometer of health to investors
So Facebook was absolutely torched earlier today at a hearing before Canada Parliament while trying to prevent legislation mirroring the Australia law they failed to stop which is now working as planned. Facebook torchings can be entertaining.
Shall I post some video? /1
for a company who regularly dismisses the importance of its display advertising biz, it sure was willing to break a lot of antitrust laws… like the state AGs vs Facebook, I'm also thrilled here, this is the exact case I wanted against Google. As promised, Texas had the experts.
Major new plaintiff allegations - many long concerning:
1 FB spent billions to protect Zuckerberg personally
2 claims "epic corporate governance breakdown"
3 adds list of "insider trading" defendants
4 documents Zuckerberg misled Congress /2
woah. new on DC docket. looks like the attorney general of DC filed 270 pages late Friday night documenting Facebook's multi-year resistance to discovery in its cover-up of Cambridge Analytica and related platform issues for 3yrs. stay with me until the end. /1
Mark Zuckerberg, on behalf of his products, primarily Instagram and Facebook, faces the full Senate Judiciary Cmte now along with four other CEOs (three under subpoena) for harming children. This is how it has begun, “Mr Zuckerberg…you have blood on your hands. /1
The sound of my jaw dropping in horror at this incredible Wall Street Journal report on Instagram. Read it top to bottom. A few things that caused me to stop and read twice, three times. /1
Imagine a company that does not change its leadership because of this: “Assessing Meta’s contribution to the genocide — which Amnesty concludes was substantial — the report finds that Facebook’s ‘content-shaping algorithms’ directly fueled killings and other abuses.” /1
It's a whopping 390 pages and there is a related 220 page suit filed in same court on the same day. Together they bring the kitchen sink on allegations as to how the platform gained market power, failed its 2012 FTC Consent Decree, covered-up and failed to disclose data harms. /3
In case y’all are just doomscrolling, a 9th circuit Judge demanding Facebook send an executive to Thursday’s hearing who can make discovery decisions regardless of their schedule obligations. And that hearing will be on zoom at 7:30pm ET this Thursday. 🍿
Judge Chhabria to Facebook in NdCal: "By no later than 4pm on Thu, Feb 10...designating a single executive who has final responsibility...must attend the conference call at 4:30pm..."
"If the executive has other plans on Thursday afternoon, they are ordered to postpone them."
Woah. Court just ruled to certify the class in lawsuit alleging Facebook sold ads based on inflated potential reach and then fraudulently covered it up. I'll link to more background on the case (and damning discovery) but first we have a few words from the federal judge. /1
CBC joins PBS and NPR in pausing its Twitter activities as Musk continues efforts to undermine the credibility of public media and the public’s understanding of editorial independence - with 5th grade humor. Falsely misrepresenting a news brand is reckless if not dangerous.
Our journalism is impartial and independent. To suggest otherwise is untrue. That is why we are pausing our activities on

TikTok? Y’all are crazy. Yes, it’s a huge problem but hypocrisy. Last year after Facebook worked years to keep it sealed, a court unsealed its secret app audit. It showed 86,961 developers in China had access to all of our personal data…yet crickets. /1
woah, I have the unsealed docs here. this is the Facebook census / fake accounts case DCN filed to get unsealed for public interest. Judge recently ruled in our favor. So I guess here come the docs. And the apparent cover-up was once again worse than imagined. Sandberg.
Worst pandemic in a century. Dominic Cummings is advising the UK government led by Boris Johnson. Jared Kushner is advising the American government led by Donald Trump.
Friday night court filings add to Facebook's horrible terrible week. Judge stepped in and ran over FB affirming expectations on negligent discovery:
1) production of Zuckerberg's notebooks
2) discovery of Zuckerberg/Sandberg
3) details on FB's secret whitelisting data deals
/1
3yrs ago today, NYT and Guardian (after threat from Facebook), broke massive scoop that Facebook's personal data had not only been sold to a political operative but FB had covered up what they ultimately labeled a "breach of trust." For 3yrs they've continued to cover it up. /1
As background, State of Rhode Island originally had sued Facebook claiming it WAY overpaid FTC by as much as $4.9B to protect Zuckerberg. It won rights to inspect a lot of docs from 2013-2019 leading to this new lawsuit which draws on a ton of evidence from all over the place. /4
Basically a full Ginsburg of comedy with ABC The View super cut, NBC’s SNL, CNN, social media, influencers, everyone in on the action. No one will remember the real words or video down the road.
Left: BBC version. Right: Leave manipulated version. Lesson: Farage agrees to BBC interview. Gets grilled but gets in his talking points. Shortly after his supporters are spreading cuts across social media with Leave instead of BBC bug and
@AndrewMarr9
cropped from visual. watch.
Peter Thiel, a
@facebook
board member, had dinner with Scott Greer, who worked for Richard Spencer, the nation’s foremost white supremacist.
No comment from Facebook about that.
Meanwhile, the vitriol and animosity whipped up on the platform in a matter of hours towards the free press creates fleeting bursts in “engagement” but lasting erosion in trust for all those who have supported Twitter over the years. 2/2
A federal judge just ordered 13yrs of targeted discovery on all communications by Sheryl Sandberg and Mark Zuckerberg related to a cover-up on their largest breach of trust in company history. I bet anyone this ends up badly for them considering they paid the FTC $5B to avoid it.
hot damn news!!! the lawsuit for the cover up of Cambridge Analytica and Facebook's data leaky app platform just escalated. In a parallel case in DC, Zuckerberg was ordered for deposition last week. Pop some corn please.
“Finally, when the president asks who you work for, don't answer CBS News or the Washington Post. When the president asks who you work for, look him straight in the eye and say, ‘the American people.’”
Must-read advice from former White House press secretary
@joelockhart
. His advice to "work together as a group" is exactly what the Beijing foreign press corps did against its common adversary, the Chinese state. Unfortunately that applies in the US now.
1) something very odd with first tweet above in terms of its amplification.
2) it seems musk, based on his reply tweet, is leaning into a claim the suspended accounts broke yesterday's new rule by promoting a live automated mastodon account tracking his jet using public info.
Here is more on how twitter manages trust and safety which may explain why the comms and lobbyists / govt relations at twitter were so out of the loop when everything hit the fan on their admittedly very bad decision to remove a news story for claimed hacked materials. 3/3
Washington Post just moved a report mainly focused on Twitter’s Head of Trust and Safety. I find this report insanely important - much larger implications. The reporters on it have particularly nuanced understanding of company, its processes and those at other social media. /1
Holy crap, this WSJ report on Facebook. It’s even worse than I expected. “He estimated the company’s automated systems removed posts that generated just 2% of the views of hate speech on the platform that violated its rules.” /1
The central allegation kicking this off is the FTC's draft settlement named Zuckerberg personally which would have caused all sorts of issues for him. The board, entirely controlled by Zuckerberg, refused and paid $5B to protect him so FTC didn't name him personally. /5
Original suit of course was filed due to Cambridge Analytica. New lawsuit has more details than anything I've seen (many sealed). Reminder, case centers on millions of stolen and sold Facebook users' data. According to suit, only .31% had consented to it being shared. /7
Whoa. A super late Fri night unsealed doc in lawsuit Facebook is trying to settle for record $700+ million. It includes this long-hidden Sep '18 "Status and Re-scoped Approach" from the unprecedented audit Mark Zuckerberg promised Congress during Cambridge Analytica scandal. /1
I heard this may be coming. I would be fairly certain it’s also a sign things are about to get real. On my short list: a-NDCal just denied transfer of section 1 market rigging claim so FB is fighting a potentially criminal allegation of market rigging based on her signature. /1
Incoming doc. DC AG v Facebook. This is the case seeking to depose Zuckerberg, Sandberg, Elliot Schrage, Joel Kaplan regarding their Cambridge Analytica cover-up. Facebook has been fighting discovery for yrs. I continue to believe they had major SEC risk from their cover-up. /1
Because it’s going to get a lot worse. PR tip: 60 Minutes has a significantly larger audience (10mm+) than anything so far and will tease hearing. In addition, there are larger problems all coming at the same time. I’ll list them in no particular order:
Where are Mark and Sheryl?
Zuckerberg hasn't posted in days
Sandberg's post from 9/29 has scalding comments 👀
@Mosseri
has been MIA since his week on Today Show and the Met Gala red carpet
latest on internal turmoil by
@MikeIsaac
@sheeraf
@RMac18
Mark Zuckerberg found the time to sit for three hours with Joe Rogan but never had the time to answer questions from international Parliaments on matters of democracy despite summons and promises to the public. What a guy.
Thread incoming. AGs lawsuit v Google posted upon orders of court. Simply put, there is A LOT. I previously called Google "screwed" despite redactions but there are more eye poppers.
I'm starting with Facebook market rigging allegations. Congrats Sheryl Sandberg on redaction. /1
The freaking United Nations documented Facebook’s role in genocide yet advertisers are still to this day debating whether they should boycott for a month because it may upset Facebook’s leadership.
