And as with the Bellamy case that he ruled on a couple weeks ago, Judge Campbell finds that Boyd's delay in filing the lawsuit weighs against his argument that his harm would be irreparable.

Judge Campbell also distinguishes between JUCOs and NAIA, finding that the counting time at fellow four-year NAIA schools makes more sense than counting time at two-year JUCOs like in Pavia. An interesting point, given that the Pavia waiver includes ex-NAIA athletes.

Reading through the opinion, Judge Campbell focused on a particular issue: his antitrust claim requires showing harm to a market as a whole, not just to himself through the denial of the waiver.

Judge Campbell -- the judge who granted Diego Pavia's preliminary injunction back in December -- remains skeptical of other players coming into his courtroom way later saying they need the same relief.

Another NCAA eligibility ruling: A judge denied the preliminary injunction of Darrin Boyd, a basketball player seeking another year of eligibility. In the filing Boyd made in July, he said he missed on $350,000 in NIL from Vanderbilt because of NCAA eligibility rules.

The Sixth Circuit Court of Appeals has just set a date for oral arguments for the NCAA's appeal of Diego Pavia's preliminary injunction. The hearing will be held on Tuesday, September 16 at 10 AM CT in Nashville, TN.

Nyzier Fourqurean v. NCAA update: The court just posted the minutes from today's motion hearing and. well, not much to update on. I'll keep my eyes open in case there's something else added. But it doesn't seem like there's any sort of judicial decision coming from today.

NIL Go, the software created by Deloitte to scrutinize whether NIL deals are "pay-for-play" is being operated manually, according to the College Sports Commission. That means that human beings are looking through every single deal and clearing it or rejecting it, rather than AI.

From a filing the NCAA just made in the Fourqurean case. Like I understand the lawyer reason why they're saying this -- the plaintiff has the burden of proof to prove alleged "facts" -- but out of context these statements are just really funny (especially given recent events).

The Sixth Circuit has historically defined a split between NCAA rules that are commercial (and subject to antitrust law) and NCAA rules that are not, placing eligibility rules firmly in the latter category. This could be a sign they're reconsidering that position post-House.

These letters give a good indication of what the court is thinking about, and these are two very interesting questions. The "Does the House settlement reflect a 'major new market reality'" hits directly at the commercial/noncommercial issue that has very much split lower courts.

More eligibility rule news: The Sixth Circuit Court of Appeals has sent a letter to attorneys for Diego Pavia and the NCAA, ordering them to file supplemental briefing answering two questions in advance of October oral arguments.
