Once the Supreme Court either denies or rules against the immunity argument, it will be settled law. The search warrant on Mar-A-lago was partially litigated two years ago when the special master order was overturned.

This absolutely insane. The appointment of Jack smith was constitutional. He did not need to be confirmed by the senate. And prior appointments(Robert Mueller) had their validity challenged only to be upheld on appeal.

The judge already said politics isn't involved in the case. The indictment clearly states it was his actions not his speech that were illegal. And Supreme Court precedent does not endorse presidential immunity in a grand jury investigation(U.S V Nixon). These motions will fail.

He's basically telling the judge that if she rules that instruction into the jury, do it now so they can seek a writ of mandamus. An order from a higher court compelling a lower court to to act when it has a clear duty under the law.

Molly Michael was on of the aides that testified before the grand jury. She also told them she was alarmed about Trump's handling of requests by the national archives and even gave the FBI documents she found. She'll be a strong key witness for the government.

Basically a writ of mandamus is a remedy that can be used to compel a lower court to perform an act that is ministerial in nature and that the court has a clear duty to do under law. When filing a petition for writ of mandamus, you must show that you have no other remedy.

His motion that the indictment doesn't clear state a violation of law is borderline frivolous. The first three pages of the indictment outline he has a right to claim the election was stolen. It's the ACTIONS he took that were illegal not his speech.

In blessings V. Trump, the D.C court of appeals ruled he wasn't absolutely immune from damages related to the attack on the capitol. That was in a civil context. The D.C appeals court will deny Trump's motion to dismiss. There is ample precedent and case law on Smith's side.

The Jack Smith appointment argument will fail. There is precedent of past special counsels being alumni's of the DOJ (Robert Mueller). And the regulations clearly state a special counsel doesn't need the advice or consent of the senate.

He is stating that the SC erred on the question presented vs the appeals court which limited its analysis on the case before them. He is stating the court did not discuss what was in front rather what future presidents will go through. Justice Jackson seemed to be the only one.

Basically doj's warrant was Granted in Part and Denied in part. Sending this back to the district court for an in camera review on a communication by communication review. Meaning the judge will review every content and determine if it's privilege by speech and debate clause.

Stop lying there was no misrepresentation. They did not formally accuse the Special counsel of misconduct. The special counsels team said it doesn't affect the case and the boxes were moved during the special masters review. This again doesn't prove anything.

This is wrong and another lie. Trump did not cooperate he gave only 15 files marked classified. Then he was served with a grand jury subpoena and still lied about turning them over. Which is why there was a search warrant that found more classified documents.

That's what happens when there is evidence of a crime on the target of an investigations phone. It's not an abuse of power, it's standard procedure. You have to go before a judge and say I have probable cause to believe evidence of a crime is on these devices and premises.
