I love it here @UMichLaw, but especially on game day, I'm missing my colleagues, students, and friends @OSU_Law / @OhioState. A decade of wonderful memories. So this video was a lot of fun to do. 👇.

My guess, as Kavanaugh and Gorsuch both mention, is that the major questions doctrine and the elimination of Chevron deference have done most of the work to address the concerns the current majority have about excessive delegations congressional delegations.

Re: Consumers Research, it feels like Gorsuch has lost momentum (and votes) for the nondelegation revival project. The majority does identify some guardrails for the intelligible principle; it will be interesting to see if the lower courts experiment with them.

It's only Tuesday, and the amount of discussion among administrative law profs on the four workarounds of CASA's elimination of the nationwide injunction has been impressive.

SCOTUS sends the HISA private nondelegation doctrine cases back to the lower courts ("GVRs") in light of Consumers Research. So the Court doesn't appear interested in taking up the private delegation doctrine now -- something I left open on my post on Consumers Research.

Kavanaugh's concurrence in the CASA case is worth a close read -- both for his defense of a robust emergency docket and his note that the holding does not extend to universal *preliminary* injunctions under the APA:
