My best friend (a Catholic priest) just told me about a real, honest-to-god exorcism he had to participate in this week. Him: The diocesan exorcist said I had to be there because it’s my parish, and demons really care about jurisdiction. Me: Demons and I have that in common.

One of the great public services that I perform as a law professor is telling students who listen to Strict Scrutiny that they’re better off listening to Divided Argument if they have any interest in learning to think and interact as serious lawyers rather than as partisan hacks.

A prominent legal prof podcast described Amy Barrett as a “school marm” and “stone cold b*****.” I stopped listening at that point. I agree with @WilliamBaude that her Casa opinion was correct and excellent. Even if that’s wrong, hard to see how this is good academic behavior.

Re: Consumers’ Research. I’ve argued that the Article III problem was a serious one because this legal issue does not “evade review” if petitioners use the right procedural vehicles to mount their challenge. (See below.). The Court’s resolution is more ipse dixit than analysis.

The Supreme Court will hear a potentially very important case on the nondelegation doctrine this Wednesday. Over at @YaleJREG’s Notice & Comment Blog, I have some thoughts on the least sexy issue in the case: Whether there’s even Article III standing. Link below 🔗👇🏻.

I have no particularly strong views on the merits, but Mahmoud v. Taylor—in particular, its careful literary dissection of several children’s books—calls to mind Justice Scalia’s dissent in PGA Tour v. Martin.

I spent two years of my life defending the Universal Service Fund in six cases across four circuits, and now I’m 15 minutes away from finding out whether it worked 🙃.

This article was hugely helpful to me in thinking through my own Vermont Yankee piece from the prior issue. A must read update on the state of admin law as applied to immigration adjudication.

When I was a child, I thought like a child, and I wondered why law professors refused to Bluebook properly. But when I became a lawyer, I put away childish things. He who is born into the law using the 19th edition will die using the 19th edition. No one learns the new rules.

I had a baby law prof milestone today: With thanks to Judge Readler of the Sixth Circuit, I got my first judicial citation. This is all the more existing because the prevailing party was represented by my friend and former co-clerk Matt Rice.

A fun thing about being an absent-minded administrative law professor is that I have a note to myself from 2023 that reads “15 cfr 744 supp 5,” and I look at it every few months and never have the slightest clue what I was hoping to remind myself to do with that.
