2/2: Prior to Loper Bright, I considered Skidmore as well as Chevron as standards of review. But treating both as canons of construction was a well-established perspective as well. Cf. (with @rdhahn1)

1/2: My own view is that Loper Bright treats Skidmore more like a canon of construction than a standard of review, at which point the de novo characterization is consistent. Whether that means a "reduced role" for Skidmore is debatable.

It’s a small point, in an opinion furthering the “neoclassical” wedge between law & policy. But the Seven County Court refers to Loper Bright review as “de novo”—suggesting a reduced role for Skidmore.

In today's #SCOTUS Seven Co. Infr. Coalition decision, emphasis on deference under State Farm when agencies exercise discretion vs Loper Bright's independent judgment for mere statutory interpretation. Fits neatly with Amy Wildermuth's & my draft article.
