I support judicial review, but if it is to survive another 250 years, the judges need to show their work. I've seen a whole lot of court orders in recent years that had more holes in them than Swiss cheese, but they were markedly better than the new genre of ex parte TROs.

Justice Jackson is putting more distance between herself and her colleagues. In her dissent today she doubles-down on her abrasive and insulting mischaracterizations about what the Court’s majority are allowing. Today’s dissent was -again - farther than either Justice Sotomayor.

TROs should be effective for no more than 3 days. At which point, if not converted to a PI, they should dissolve and not be renewable. TROs should be the true emergency step leading to an appealable PI decision, not a means of illegitimately claiming unchecked authority.
