President Trump’s proposed higher education compact may provoke some useful dialogue around reform. But the federal government shouldn’t try to manage the nation’s 6,000 colleges and universities, writes @SenAlexander

His higher-education ‘compact’ is a case of federal overreach, even if some of its ideas are good.

New over at ELB: "Miscellaneous thoughts on Callais"

I confess, I’ve found the litigation saga surrounding Callais quite complicated (including what, precisely, re-argument was supposed to accomplish, and why Justice Thomas wrote separately this summer...

Barrett repeatedly asking about congruence & proportionality at oral argument today. As I noted back in 2023 in Allen v. Milligan, I identified it as noteworthy that Thomas, joined by Gorsuch & Barrett, flagged this standard in dissent in n.19: https://t.co/eYugePTgha

It's not clear why this photoshopped image is going viral. Santa Clara is de facto (not formally) capping tuition around $50K, but indirect costs will be on top of that, not enough to prevent many students from going to private loans.
Santa Clara is one of the first law schools to publish 2026-27 tuition. Historically, Grad PLUS loans have had no limits. Starting next year, professional school borrowing will be capped at $50k/year. Notice anything about the trend in tuition? I expect many schools to copy this.

Reading @ProfRobAnderson on the evolution of the poison pill, I wonder: how many legal novations were developed because of just one attorney's inspiration, essentially willing it into being? https://t.co/V367jB0Kfa

Existing accredited schools remain accredited in the eyes of Texas. New regulations will be forthcoming, but they will be no more onerous than the ABA & will give opportunity for new schools to be recognized.

The Texas Supreme Court has stripped the ABA of its role as accreditor of law schools for purposes of bar admission in the state. https://t.co/T3RYBfc9lD

This is the rare case where the "burden" is found to be a "minimal" burden on voting rights under the Anderson-Burdick test, & still fails constitutional review according to this panel. I'll be watching en banc/SCOTUS review for this one.
BREAKING: 3rd Circuit panel rules, 3-0, that Pennsylvania law requiring discarding undated or misdated mail-in ballots violates U.S. Constitution. Judges: Shwartz (Obama), Freeman (Biden), Smith (GWBush) Doc:
