That there were a clutch of appearance-based judgments, and that they all, to the best of my knowledge, related to men who wished to be treated as women, suggests to me that some judges let their clarity of thinking about what could possibly work in practice as a set of rules/.

Not only does the statute not make assumptions about appearance, it's impossible to see how any sort of personal legal rights could ever be based on how others sees you. Who decides? How? Everyone? Always? If not, who, when? It's a prescription for policy and legal disaster./.

The Supreme Court engaged with this issue of "passing" and recognised that both the protected characteristics of GR and the criteria for getting a GRC do not depend on someone looking the part.

The report itself was a bells and whistles, kitchen-sink, thing, written in unusually personalised prose. Whether it was what was really needed, to make any change happen in practice, rather than satisfy a desire to present the most full-on package possible, is a fair question.
