Not only does the statute not make assumptions about appearance, it's impossible to see how any sort of personal legal rights could ever be based on how others sees you. Who decides? How? Everyone? Always? If not, who, when? It's a prescription for policy and legal disaster./.
The Supreme Court engaged with this issue of "passing" and recognised that both the protected characteristics of GR and the criteria for getting a GRC do not depend on someone looking the part.

I can’t understand the delay in indicting Peter Murrell. It’s way past time the detail of the charges against him were in the public domain.
