It is unsurprising to see the nwc used here. The Supreme Court's decision (2015) to constitutionally recognize the "right to strike" overturned precedent, expanded the original purpose of s.2(d), and came only after Abella J granted this brand new right "benediction."
@GK_Fellows I read his post as saying governments have invoked back to work legislation and did not engage s. 33, so the Alberta government did not need to do that here. While *generally* true, when governments use back to work legislation, they refer the dispute to binding arbitration. So

Disagree. The NWS clause can violate rights. I think Quebec’s Bill 21 does. There are also situations where legislatures use it in good faith because they believe Courts have gotten rights wrong. No better example than labour rights, which Courts just plucked out of thin air.
The legislation is supposed to embargoed until tabled, but if this is accurate… Smith is invoking the notwithstanding clause to force teachers back to work. Which is an admission that she is violating charter rights. It is a dark day in Alberta. #abpoli #ableg #cdnpoli

Land acknowledgements can be performative, but aren’t inherently offensive. However, claiming that land is “unceded” or “stolen” is political, and intentionally so. It’s inappropriate for public school teachers to take sides in legal and political debates in the classroom.

Ontario’s AG seems to have recently decided to start laying charges for online speech. Bill C-9 would it easier. There are endless statements online that could meet the fuzzy definition of hate speech so I fear we’re sleepwalking into a UK-style free speech crisis. Let’s not?

Recommend @EliLake’s Breaking History pod on free speech in Britain. But it contains an error. The Times reported 12,000+ speech arrests/year (not 1,200). That doesn’t include data from all police, ‘stirring up’ charges, or buffer zone arrests. 😳

Politicians won't say this out loud, but if the U.S. wants a big chunk of our auto industry, there's nothing we can do to stop that. We should accept a smaller auto industry and let capital flow into stronger sectors (services, natural resources). Australia did this successfully.
