Wowza! Another strong nomination. Former law professor and current member of the superb White House Counsel team. Can't wait to see who else is going to be nominated by President Trump!.
I am pleased to nominate Jennifer Mascott to serve as a Judge on the United States Court of Appeals for the Third Circuit. Jennifer clerked for Justice Clarence Thomas and Justice Brett Kavanaugh, where she learned much about upholding the Constitution, and safeguarding our.

Congratulations to Aaron Sibarium, recognized by the former executive editor of the New York Times ad a journalist that has made a real life difference in higher education through his reporting!.
Jill Abramson, the former executive editor of the New York Times, describes the Free Beacon as a "potentially lethal weapon aimed at elite universities," writing that its "jihad" has "left blood on the floor at Harvard, Columbia, Stanford," and other top schools. High praise.

Huge win today for @AGTimGriffin at the Eighth Circuit--vacating a preliminary injunction against enforcing their anti-indoctrination law. (And big win for the amicus led by @AGIowa.) This common-sense unanimous opinion by Judge Grasz agrees that curriculum is government speech.

Another expert on the judiciary weighs in:
If true, there is a plausible claim Chief Judge Boasberg violated Canon 2A of the Codes of Conduct by speaking publicly about a litigant with pending litigation before him. He should recuse from all Trump administration cases and I anticipate a judicial misconduct complaint to be.

Senior members of DOJ, including the Deputy Attorney General, also appear to be concerned by this reporting:
A newly revealed memo confirms that at least some federal judges were predisposed against the Trump administration. This is a serious breach of the judicial oath and a threat to the rule of law. Every litigant, regardless of politics, is entitled to a fair forum.

Also weighing in on the conversation is Professor @Vermeullarmine. It is not totally out of bounds to treat the President different from other litigants. But it is odd to treat the President *worse* than other litigants.
@jimmy_esq I take your point, but the President is not just any other litigant. The Court has told us repeatedly over the years that the President occupies a “unique position in the constitutional scheme” and should receive the strongest presumption of regularity. This isn’t just an.

More in response to the perspective that this memorandum is not so big a deal, here:
@jadler1969 @jimmy_esq Here's my partial explanation. But I'll go one step further. When D. Maryland Chief Judge imposes a standing order that abandons legal principle (auto-injunctive relief in habeas) I do not see a defense being that standing orders are the Chief's job

For those who are interested, I was called out for succumbing to silly concerns, and posted a response here: Happy to share good-faith criticisms as always!.
@jimmy_esq I appreciate your as always supremely confident and acerbic responses. The answer to the question I asked could be no. But the entire situation organized around treating President Trump and his administration as doing anything other than following the law is odd.

Yikes -- pretty bad timing by Judge Boasberg. It is a real shame that judges are not extending to President Trump the same grace as extended to any other President. Especially given his zealous commitment to the rule of law and norms
Around the same time Emil Bove was NOT telling his attorneys to ignore court orders, the judge at issue was telling his colleagues that Trump would—and the Chief himself said that was unlikely. Bove wanted zealous advocacy and Boasberg assumed bad faith *before* the outset.

Must Chief Judge Boasberg recuse? One reason for recusal is the appearance of impropriety. Given the public reporting on the Judge's specific concerns about President Trump I think it has to be addressed. Even if the Judge can be neutral, the appearance here is đź‘€.

Nation of origin discrimination is illegal. Is it illegal to give American citizens worse prison sentences than illegals or immigrants? I'd think so--time to ask some civil rights litigators!.
I have zero doubt that these judges in Minnesota deliberately impose lighter sentences on foreign nationals than American citizens.
