Almost all senior lawyers I interned with as a student assumed a right to shout at/bully juniors or poor clients--but never at anyone powerful. All of them 'human rights' lawyers. Must be the caste system that ingrains this 'right' to utterly humiliate anyone less powerful.

Today, the Indian Supreme Court admitted my petition challenging the constitutionality of S 9(1) of Citizenship Act. Post-pandemic realities have forced me to apply for naturalisation in my country of domicile. But I won't let my Indian citizenship be terminated without a fight.

Like #Art370 , #ElectoralBonds case was legally easy but politically hard. Unlike #Art370 , Indian SC has been brave to strike down anonymised political donations. Even so, its failure to grant interim stay 7 years ago means BJP can outspend the combined opposition many times over.

Perhaps Indian law schools should consider prioritising quality over quantity wrt project/course work. IMO a single (10k words) research paper written under proper supervision over the final year would have been worth many times the 60 papers I wrote during my UG degree.

Even desk rejects use v. scarce+unpaid editorial time, with zero gain for authors. 4. Properly researched articles remain very welcome.

In #EqualMarriage case, #IndianSupremeCourt should surprise us by writing a single opinion (if unanimous) or two (if there is dissent) + ensure no opinion is longer than 50 pages. Overlong, ostentatious, multiple opinions tend to serve judicial egos & are bad for legal certainty.

Legitimacy of judicial review is a side show that has gone on for far too long (because lawyers still dominate the discipline). Constitutional Studies must divert its scholarly gaze to: (i) the climate crisis, (ii) material inequality, & (iii) political party-state relations.

Justice Muralidhar ‘has been’ a HC judge for five years. There is no requirement that the appointee must currently be a HC judge. He is also a distinguished jurist, one of our most distinguished. There is *no* reason u/ article 124 why he cannot still be appointed to the SC.

One of the worst, but all-too-common, tropes of Indian legal writing that I notice as an editor is: (i) Take an Indian problem (ii) Find the American 'parallel' (iii) Apply. Apply. Apply. (iv) Citing Indian scholarship on the matter optional.

The Places of Worship Act is clear - by opening up gyaanvapi the SC is basically throwing out the rule of law and creating jurisprudence based on majoritarian sentiment. That isn’t, never was and shouldn’t ever be their job.

This has to become a norm—cops who fail to show reasonable legal grounds for an arrest must be made to compensate the victim out of their pocket. If the arrest is malicious, criminal prosecution of the officers must also follow.

Renewed effort w/ @ShashiTharoor for anti-discrimination law. He presented the union bill I helped draft to Lok Sabha in 2017 w/o success. Hope Kerala will become 1st Indian state to enact a comprehensive antidiscrimination law for public + private sector.

A government gets its appointed chair to deem controversial bills passed by a 'voice vote' in the upper house. No actual counting of votes. Legislative numbers rendered irrelevant. This isn't one of the thousand cuts. This is an axe blow to our democracy.
