The FTC lost their first big tech antitrust case against Meta. What does this spell for their other case, against Amazon, slated for trial in 2027? Well for starters, a gerrymandered market of just 4 players isn’t going to cut it.

Today a court ruled that the FTC had failed to prove Meta's acquisitions of Instagram and WhatsApp violated antitrust laws. TLDR they said Meta is not a monopoly (which to me seems pretty obvious) An immediate reaction thread on why this is good news for more than just Meta

The wins in these cases are not primarily wins for specific companies. They are wins for free competition, dynamic innovation, and, ultimately, the consumer.

Instagram was considered a risky bet and a late night joke when then Facebook acquired it. A win for the FTC could have rendered many more business decisions subject retroactive reviews in ways that don't reflect the reality of the market either in the past or present

Additionally, a win would have sent a negative signal around mergers and acquisitions. It could have chilled important acquisitions more generally but particularly in the tech sector.

As I discussed when oral arguments were being heard, breaking up Meta would not benefit consumers and could even make it harder to improve products for consumers along the way (and not solve the other policy concerns the FTC mentions either)

Starting with the obvious this is another example of courts rejecting attempts to make #antitrust more than its current objective standard. Doing so would shift the focus off consumers on to things that are far more subjective and political and could fail to benefit consumers
