Notably, our settlement requires Deliver That to rescind its forced arbitration clauses. Forced arbitration clauses prevent workers from bringing claims in court when their rights are violated. They silence workers and shield companies from public accountability for wrongdoing.

Under our settlement, DeliverThat will reclassify DC-based drivers as employees. This will ensure that drivers receive essential workplace rights. DeliverThat will also pay $70,000 in worker restitution — reflecting the proper wages it failed to pay — and $30,000 in penalties.

DeliverThat is a gig food delivery company. We found that it misclassified 133 DC drivers as independent contractors — despite exercising control over them as an employer. As a result, workers were denied minimum wage and overtime pay, paid sick leave, and pay for split shifts.

CASE UPDATE: The DC appeals court just ruled that our lawsuit against Meta for allowing millions of users’ personal data to be exploited — including 50% of District residents — can move forward. Now, we will continue working to hold Meta accountable for allowing third parties to.

@DC_DOB One of the developers appealed the order to the Office of Administrative Hearings, which affirmed the order. The developer then appealed to the DC Court of Appeals. We went to court and won the appeal — affirming DOB's authority to order the developers to fix structural issues.

Inspections by @DC_DOB and engineers revealed serious structural problems. The building had been built in violation of DC regulations and lacked proper structural support. DOB issued an Order to Correct requiring the developers to install structural supports to ensure safety.

Our other case focuses on 4022 Georgia Avenue NW, a Ward 4 condo building. Its construction was so faulty that the building physically sways on windy days, endangering its residents and damaging their homes. The residents reported these issues to the developers and DC agencies.

This month, the DC Court of Appeals upheld the contempt finding and sanctions — calling the evidence "staggering.". Our Marbury Plaza case continues. We won summary judgment in late 2024 and have moved to the penalty phase. We are fighting for tenant restitution and penalties.

In 2023, the Court found Marbury's owner in contempt and ordered rent refunds returning over $5 million to tenants. As the case continued, the owner appealed the contempt order and even attempted to claw back rent refunds tenants already received for the conditions they endured.

In 2021, we sued the owner of Marbury Plaza, a 674-unit building in Ward 8. Tenants were exposed to horrific conditions, including mold, leaks, flooding, rodents, failing plumbing, broken elevators, and more. The owner repeatedly ignored a consent order to repair these issues.

HOUSING WINS: We won appeals in two important housing cases in DC. We successfully defended rent refunds for 2,500 tenants at Marbury Plaza in Ward 8. And we upheld an order requiring developers to fix faulty construction that left a Ward 4 condo building to sway in the wind.
