For clarity, an ET judgment only binds parties in a particular case & does not make case law as some would have it. Plus a lower court can't overrule a higher court so anyone viewing Peggie or Kelly judgments as an insight into what the SC 'really meant' is talking mince!

It is genuinely astonishing to read a judgment where an employment tribunal judge misquotes the UK Supreme Court. Not paraphrases. Not summarises. Misquotes.
This is an incredibly disturbing bit of misrepresentation by the tribunal judge. He edits a line from the FWS judgment (black background) to remove the word "trans" from "trans woman", and then cuts the - very important - rest of the sentence. https://t.co/QObPErVgsv

The Times on the Peggie judgment: âseveral of the citations used to support the judgment's conclusions are at best wildly misleading and, in some cases, possibly entirely fake.â A serious allegation requiring IMHO an urgent judicial response to maintain public trust in the law.
