This whole gambling tax issue comes down to this, for me. It's more than a legal/wonky issue. It's a moral/constituitional one. There should not be a way for the government to levy taxes on your *losses* as if they were *profits*.
@kellyinvegas @PropBetGuy There should be 0 people in this country paying tax on phantom income. There is no other position to take on this.

@CommonSensei22 @PhilGalfond They're not losses in the traditional sense. If I win $10 on one bet and lose $10 on another, that's a net of $0. The tax code treats it as $10 of earnings and $10 of losses, and currently lets you deduct losses up to the amount you won. So you pay taxes on net positive winnings.

If I sell a stocks one year for a $10,000 gain then sell others for a $10,000 loss should I owe tax on $10,000? . These are the types of moronic takes I’m seeing in the replies to some of these gambling tax posts. And don’t get me started on gross revenue - business expenses.
