Regarding US v Beshear, @kyoag makes it clear that in-state tuition is for legal citizens. Grateful to @realTJRoberts for being ahead of this issue and filing HB352 this past session to end undocumented students from receiving in-state tuition.
Federal law is clear – illegal immigrants are not eligible for in-state tuition or any other benefits that are kept from American citizens. If the CPE and Governor Beshear want to continue ignoring federal law, I fully expect them to lose in court.
