Descheduling will empower Big Marijuana to flood markets with highly addictive concentrates—like 90% THC vapes—without potency caps or oversight. The DPA’s omission of these risks, and its use of social justice rhetoric, raise alarms about their alignment with industry.

The DPA’s proposal also ignores legal precedent. A Supreme Court ruling (Gonzales v. Raich, 2005) supports federal regulation of marijuana. Descheduling without safeguards could open the door for interstate trafficking of ultra-strong THC products, destabilizing states that still.

This spike in potency makes today’s marijuana pharmacologically very different—and far more dangerous. High-THC products are linked to psychosis, addiction (affecting 30% of daily users), and cognitive impairment—especially among youth.

The DPA’s claim that descheduling is the only way to end federal criminalization neglects a key reality: modern marijuana is drastically more potent than before. THC levels have surged — from just 3.96% in 1995 to over 16% in 2022, per DEA data.
