States can apparently charge even more than $35 for “non-emergency” ER use. But part of the reason people go to the ER is because they don’t know if a symptom is an emergency. When you punish them with copays they avoid the ER altogether. Deferred care can equal dead bodies.

This provision has gotten relatively little attention, but it is ghastly. Imposing $35 doctor copays on sick people barely above the poverty line (e.g. $16,000 / year for single people) just means they don’t go to the doctor.
The “One Big Beautiful Bill” would require states to impose cost-sharing of up to $35 per service for some Medicaid enrollees enrolled through the ACA Medicaid expansion with incomes between 100% and 138% of the federal poverty level. Get the details:
