If there is one case to show the high threshold of Article 13b, perhaps it is this - following analysis of risks posed by war, middle strikes and nuclear attack, return of an abducted child to Ukraine ordered, in part given location within country. Fascinating case!
Q v R [2022] EWHC 2961 (Fam) (21 September 2022): Application by M for return of child to Ukraine, the mother and child having come to this country following the invasion of Ukraine by Russia. Return ordered, despite F's Art 13(b) defence. Full report:
