Berman is the Acting U.S. Attorney by dint of a *judicial* appointment. There’s a pretty good argument that, per the plain language of 28 U.S.C. § 546(d), he gets to keep serving in that post until the *vacancy* is filled (through Senate confirmation of a permanent successor).

When the Secretary of War, Belknap, was tried in 1876 following his impeachment and resignation, he was no longer holding office in the federal government. That is our only precedent, and it permits this case. There is no precedent on the other side.

In order to invoke the 25th Amendment, all that needs to happen is for @VP to transmit a letter, along with a majority of Trump's cabinet, to @SpeakerPelosi and @ChuckGrassley saying that @realDonaldTrump is unfit for office. Pence would immediately become the Acting President.

The NY Ct. of Appeals ruled that @PaulManafort can't be prosecuted under NY law for crimes closely related to the federal offenses for which he was tried and pardoned. But presidents have no power over state crimes, and thus the federal pardon should free Vance up to prosecute.
