Just to be clear about what this means. If Colorado had not opted out, banks could ignore state-approved caps on interest rates and fees. Instead, they could charge as much as 200% interest.

But it also had an opt-out provision, and that's what Colorado did with HB23-1229. We opted out of DIDMCA. The Colorado law was supposed to go into effect July 1, 2024 but the big banks challenged it.

The federal law is known as Depository Institutions Deregulation and Monetary Control Act of 1980 or DIDMCA. It allowed banks located outside Colorado to ignore our state's caps on interest rates and fees.

Colorado has a history of protecting consumers from high payday loan interest rates and fees. In keeping with that tradition, legislators passed HB23-1229, which allows Colorado to opt-out of a federal law.
