With respect, a correction: the argument is that (a) children of tribal members are not "subject to the jurisdiction" (excluded from 14th A birthright); (b) thus, children of undocumented parents are excluded. (a) correctly states the law. Natives have statutory citizenship only
This is quite incredible. The US Justice Dept, under Trump, is defending its birthright citizenship Order by arguing that immigrant children covered by the Order cannot be citizens because... the children of Native Americans aren't US citizens.
