Trial lawyers: if you need a factum written, give me a call. I do freelance factum-writing on top of my appellate practice, and I'm happy to take on your writing projects so you can get back to cross-examining.

Shocking statistics in story by @SeanFineGlobe in Globe and Mail this morning. 80% of inmates in Ontario jails are being held on remand (with another 4% being immigration detainees.) That’s a lot of innocent people behind bars. In 1990s, around 25% of inmates were on remand.

This is something to keep in mind right now - especially in conversations with Jewish folks and people of Palestinian ancestry.

Antisemitism is always wrong. Islamophobia is always wrong. I don't know the path to peace, but I know that it must begin with recognizing our common humanity.

Important case from @ONCA_en confirming that out of court mixed statements led by Crown have exculpatory value even where accused testifies and adopts them notwithstanding it then becomes a prior consistent statement:

R. v. Sureskumar, 2023 ONCA 705: to determine whether a search incident to arrest was conducted reasonably, the court must ask whether the search was necessary. See paras. 14-19. https://t.co/kQxsPJhwdW

We only hear about the passport office when things go haywire. So let me say that the staff at the Burnhamthorpe Rd @ServiceCanada_E @PassportCan office yesterday was fantastic. Everyone was friendly, patient, and helpful.

I had coffee with a stellar former student yesterday who asked a great question: "I know it’s important to keep in touch with mentors & former supervisors but how do you recommend doing that?" Here was my answer:

Friendly reminder that @DShulman_ESPN and @SiddallJoe are an absolute dream team in the @BlueJays broadcast booth. Dan is as good as they come, and I learn something new about baseball every time I hear Joe speak. Hey @Sportsnet—keep these guys around.

Bencher election voting starts tomorrow. For those (like me) who oppose Stop SOP / Full Stop and everything they stand for, the 2019 election is often discussed as a worst case scenario. But the reality is that 2023 could be worse. A thread… 🧵

Gerald Chan is an excellent lawyer, and he will be an excellent Bencher. I'm encouraging all of my colleagues to cast their votes for Gerald and the whole @BGG_Coalition slate.

Some final thoughts on the eve of the Bencher election voting period. I am enormously proud to be a lawyer. I didn’t grow up around lawyers. I wasn’t encouraged to go into law because of a perception in the Asian Canadian community that the profession was inaccessible to us. /1

Lots of great appointments yesterday but a particular shout out to Stephen Bernstein who has tirelessly and brilliantly defended clients charged with the most serious offenses. The defense bar has lost one of its stars but the system has gained a great Judge.

Professor Sankoff's CDE is hiring. Also open (at neg. salary) to a criminal lawyer with the right skill set who wishes to reduce practice and move partially into content/design. They could continue doing some legal work through @SankoffLaw. Pls RT! https://t.co/UcU0m9c2dz
