The project includes an electric fence to exclude wildlife from the resort area! The project would cause irreversible ecological damage to one of Goa’s most sensitive wildlife habitats and is designed to present the Court with a fait accompli. 7/7

It also violates the Forest Conservation Act, 1980, which requires prior approval from the Central Government for any diversion of forest land for non-forest purposes. 6/N

The PIL alleges that the resort land lies entirely within the core area of the proposed tiger reserve, an ecologically sensitive region known for its rich biodiversity, including tigers, sloth bears, leopards, pangolins, vipers and over 300 unique plant species. 3/N

To bypass the High Court’s order, the Goa government brought in an ordinance. This ordinance also lapsed. In order to save the approvals and permissions granted under the ODPs, the Government next went in for an order issued under Article 162 of the Constitution. Set aside. 4/N

The judgment cancels the circular dated 22.12.2022 issued by the Chief Town Planner keeping the ODPs illegally alive, after the 5 villages had been removed as Planning Areas under the Town and Country Planning Act. The High Court had stayed the circular. 3/N

All zoning certificates issued for construction on the basis of the ODPs have been cancelled. This means that all development on these plots must conform to RP 2021. If not, the development will have to be demolished. This is confirmed by the SC interim order in this matter. 2/N
