The CAFC opinion doesn't mention patent false marking under 35 USC ยง 292, whose specific enumeration might counsel against reading Section 43(a) this way. But Dawgs raised this point in its briefing, and it seems Crocs did indeed try a ยง 292 attack below without success.
& why shouldn't it, *if* consumers believe & are deceived by the false claim & it's material to their decision to purchase the shoes?.
