I teach a class on scientific legal evidence. What peer review is does come as a shock to many students. I don’t think they come in believing that it is a replication attempt, but they do tend to think that it’s some kind of in-depth audit.

How old were you when you learned “peer review” isn’t “we followed your procedure and replicated the results of your experiment” and is instead “ya I read it; looks like it could be legit” ?.

A second paper will focus on how courts shape the space that litigants have for strategic behavior.

This is the first paper, which focuses on the role of strategy in civil litigation. I argue that strategy functions as a de facto procedural value, sometimes trumping more commonly recognized values such as accuracy, efficiency, and fairness.

I am grateful to many of you who have provided comments on earlier versions of this paper. If you did, you may notice that this is quite a different paper. I realized that this was the proverbial paper that is two papers, and decided to spend some time separating them.
