You have to plead guilty to get any kind of treatment in SD Drug Courts. All kinds of reason to exclude: strike conviction, actual/suspected gang membership, sales/transport, etc. Proseuctors have wide discretion on who gets in, who doesn't. https://t.co/m1va5v4ly3

In addition to reclassifying some misdemeanor crimes to felonies, Proposition 36 also opens the door to pushing defendants into court-mandated drug treatment.
