In June 2024, Modi govt replaced Indian Penal Code (IPC) with Bharatiya Nyaya Sanhita (BNS) and got rid of IPC Section 377, the only law that penalised rape against men. Opposition party MPs had raised this issue before BNS came into effect, but the govt ignored the concerns.

It is very concerning that the govt thinks that this definition is "too broad". It raises alarms that the govt may challenge the principle of NALSA and may encroach upon our rights, especially rights of trans non-binary persons & trans persons who choose not to undergo surgery.

Trans Act defines a trans person as anyone facing gender dysphoria, or an intersex person or a genderqueer person or a person belonging to any socio cultural identities like Kinnar, Hinra, Aravani and Jogta. It specifically states that medical intervention is not necessary.
