Honored to be recognized by
@On3sports
as one of 50 leading college sports voices in the nation within their 2023 “State of College Sports” report.
I’ve shared my views on the biggest issues facing NIL and college sports generally alongside NCAA President Charlie Baker, Kentucky…
“All six of the company’s bread options — Italian white bread, Italian herbs and cheese, nine-grain wheat, hearty Italian, nine-grain multi-seed, and honey oat — were deemed too sugary by the court to qualify as bread.”
Here are the
@PatMcAfeeShow
comments that Brett Favre claims are defamatory.
Not only does Favre have to show Pat acted with “actual malice“ (essentially that he knowingly lied), he also must show Pat was stating FACTS and not just his OPINION.
I’ll put Pat as a -500 favorite.
According to the
@WSJ
, the NFL reviewed 650,000 emails during its investigation into the Washington Football Team's workplace culture.
Either Jon Gruden had the only offensive emails within the 650,000 or - far more likely - his were the only ones ownership ALLOWED to come out.
On replay review, it is CLEAR that Gavin actually won the first overtime 6-5. It should never have gone to double overtime. We may need an appeal to
@drpepper
HQ.
There will be lawyers…
Is real life? Last week, after years, NCAA said it couldn’t conclude that Baylor violated rules when the school failed to report/respond to allegations of sexual violence… meanwhile, the NCAA starts a witch-hunt against Nebraska for holding practices?
You are the problem, NCAA.
Nebraska & Coach Scott Frost under NCAA investigation for improper use of analysts, sources told

THE ANNOUNCEMENT:
You forgot? Many did. Others, however, searched for truth.
The story is now being told. What went on at Big Ten HQ??
One thing changed between Cancellation and Football, a B1G Lawsuit. Story time—
HOW NEBRASKA SAVED BIG TEN FOOTBALL 🎥
A message to all of my new Tennessee followers
Sports Lawyers have long waited for THIS lawsuit. We figured it would come from the Power 5 just didn’t know who would take the shot.
And here we are. You’re currently the epicenter of the Sports Law Universe.
Grab your popcorn 🍿
Refs did not call a holding penalty against a Nebraska opponent over a 2-year stretch (574 snaps) because of a direct command from the Big Ten Conference.
Per reports,
@EASPORTS
is making a big announcement on July 20th about the return of an “old sports franchise.”
With the onset of the NIL era… not only is a path cleared for the return of the NCAA Football video game franchise… but athletes would get PAID for appearing in it.
There is an old adage among lawyers that says, "If you have the facts on your side, pound the facts; if you have the law on your side, pound the law; if you have neither the facts nor the law, pound the table."
See, Brandon Marshall being absolutely wrong.
Nebraska’s Attorney General has issued a letter to Big Ten Commissioner Kevin Warren warning that the conference appears to be non-compliant with the Nebraska Nonprofit Corporation Act.
The letter sets a 9/21 deadline for the conference to prove cancellation followed B1G bylaws.
Ask yourself why now? Was it to get out from under Jon Gruden’s albatross 10yr / $100M record contract to coach the Raiders until 2028… or did they need a fall guy to try and divert everyone’s attention from the WFT chaos.
If owners wanted this kept secret, it would have been.
BREAKING: Steve Cohen’s bid to buy the New York Mets for $2.42 Billion has been formally approved by Major League Baseball’s Ownership Committee.
More:
Just think... Ohio State versus Alabama could have happened this weekend if the Big Ten didn’t deny Nebraska’s request to add a non-conference game.
An ILLOGICAL decision at the time... and perhaps a FIREABLE one if it costs the Conference a shot at the National Championship.
FUN FACT: Mike Tyson once punched someone and was hit with criminal charges for assault with a deadly weapon.
Yes, his hands were legally deemed lethal. Here are his best knockouts of all time.

John Thompson Jr. leaves behind a rich coaching legacy.
He had 4 hall of famers during his time at Georgetown: Alonzo Mourning, Dikembe Mutombo, Patrick Ewing and Allen Iverson.
Here’s Iverson on the importance of Thompson in his life. More than a sport.
Dan Snyder was the subject of the Washington investigation, not Jon Gruden. And he was tied to some pretty gross accusations himself.
No written report. No Snyder emails. So do those other 650,000 emails really have nothing that paints ownership in a bad light? Seems improbable.
Bombshell allegation included within this new report from the
@WashingtonPost
.
It is claimed the Washington NFL Team made a secret nude video of cheerleaders for team owner Dan Snyder.
LINK:
It would be a real shame if someone were to dig up the video of an allegedly sober Rob Manfred presenting Corey Seager with the 2020 World Series MVP trophy especially since that video has otherwise seemed to vanish from Twitter.
Would be a real shame if someone were to do that.
Congress issued a 79-page report into Dan Snyder and the Commanders.
If you’re looking for the bombshell it’s on Page 42. The report states that the Washington Commanders leaked the Jon Gruden emails that resulted in his resignation. “It came out of their side.”
It’s all starting to make sense now.
Back in 2020, the Washington Post obtained a text between Dan Snyder and John Moag, attorney for the three minority partners looking to sell their shares of the team.
Moag threatened Snyder "you know what I know…it’s the more serious shit.”
Still can’t understand these random attacks on Nebraska.
Why does their record matter?
Why do people feel the need to point that out?
Who else had the courage to sue the Big Ten?
No one.
They should get credit for bringing the season back — because THEY DID. End of story.
So everyone’s clear, the fan who caught the Albert Pujols 700 HR is the LEGAL OWNER of the ball. See, Popov v. Hayashi (Barry Bonds 73rd HR case).
Fans are not required to gift it back to the player for free. It’s a 6-figure decision and that money may be life changing to them.

ROLLER DERBY TEAM FILES A TRADEMARK FOR “CLEVELAND GUARDIANS”
Remember when the

said there was “nO pRoBlEm” with the name? Now we have an epic battle here.
It seems that a Billion Dollar MLB Franchise colossally botched the name change.

How is Nebraska asking to replace Wisconsin an embarrassment??
Too much hate coming toward the Cornhuskers. After all, their lawsuit helped the Big Ten return. They demanded answers UNDER OATH and, instead of complying, Warren & Co. brought football back.
Would love for the Big Ten to explain how Maryland can cancel against Ohio State with 8 positives when Minnesota is playing against Purdue with this...
Source: Minnesota football will be without 20 players tonight against Purdue, as it continues to deal with COVID-19 and injuries. They will also be without multiple staff members, including OL coach Brian Callahan.
👋 NFL
The Rams played in St. Louis for 20 years. During that time, they won a Super Bowl, rostered several Hall of Famers, & had some of top attendance numbers in the league.
Paying STL $790M to settle a lawsuit doesn’t give you authority to whitewash history.
@STLRamsHistory
“This is jail time type of fraud.”
Bombshell reports today about a “secret” $55M loan the Washington Commanders took out “without the knowledge and required approval of [Dan] Snyder's minority partners.” This loan has been the primary focus of federal prosecutors. Not only that,…
Zac Taylor Timeline…

🚨 BREAKING:
In the battle over “Cleveland Guardians,” the Roller Derby team has now opened up an online store with “Cleveland Guardians” merchandise.
They seem to be applying immense pressure on the baseball team to either pay them or change their name.
Sadly, the NFL has faced this Henry Ruggs issue before.
In 2009 Donte Stallworth pleaded guilty to DUI manslaughter. He could have been sent to prison for 15 years but only received 30 days. He was suspended by the NFL for the following year but ultimately played 3 more seasons.
“If the Big 10 reinstates football for early October, I’m going to go silent, withdraw my FOIA requests, and disappear. I never had any objective other than to give players and coaches the opportunity to prove they can play fall football safely.”

IT’S HAPPENING!
Cleveland Roller Derby Guardians have sued Cleveland Baseball Guardians for stealing the name.
“We know we are in the right, however, and just like our athletes do on the track, we will put everything into this effort at the courthouse.”
An unfathomable error in the Kentucky Bar Exam resulted in a number of applicants being told they PASSED THE BAR when they actually FAILED.
Those affected were not advised of the egregious mistake for several days-- after they had already celebrated their momentous achievement.
Sen. Marsha Blackburn just eviscerated the NCAA
"The inability of an organization that makes a tremendous amount of money, whose leadership is paid a tremendous amount of money... is why the states have taken it upon themselves to do what the NCAA has proven INCAPABLE of doing."
Can confirm reports that ex-Dolphins coach Brian Flores has indeed filed a class action lawsuit against the New York Giants and NFL, claiming racial discrimination.
His complaint alleges he can prove Giants interviewed him as a "Rooney Rule" after deciding to hire Brian Daboll.
🚨 BREAKING:
NHL announces full investigation into allegations that Evander Kane of the San Jose Sharks has been betting on his own games with bookies.
The allegations came from an Instagram account purporting to be his wife, Anna Kane.
Nebraska to the Rescue?
Per reports, Big Ten is considering revising rules for the Buckeyes if Michigan cancels. Keep in mind, if Minnesota ALSO cancels, their opponent (NEBRASKA) can give Ohio St. a 6th game.
How ironic would it be if Nebraska saved the Big Ten's season TWICE?
St. Louis was on the verge of trial in front of a St. Louis judge and jury about a case where the NFL allegedly stole a team from St. Louis.
STL held the cards. $790M is a ton but disappointing to the public to cash in without an expansion team and without sticking it to the NFL
On Monday, Rutgers fans on message boards legitimately wanted to SUE the NCAA because they felt their team was deserving of a spot in the NCAA Tournament.
On Tuesday, they lost their opening round game in the NIT.
…The Law of Ball Don’t Lie 🏀
You can’t make this stuff up.
Cleveland Guardians new sign goes up at their store on the first day of new branding and immediately collapses.
This era of Cleveland Baseball may actually be cursed. Perhaps they should not have blatantly stolen the name from a Roller Derby team.
Trevor Bauer just got suspended for 2 years.
Deshaun Watson got a $230M fully guaranteed contract.
One of them has 22 active cases against them. The other has zero.
I’ve done a lot of cool things in my Sports Law career… but none cooler than this.
All I can say for now is that I’m working on a top secret project that will make Nebraska fans very happy… and might not be so well received at Big Ten HQ.
I may have said too much… stay tuned
Per reports, the Steelers GM said he’s more likely to draft someone who played in 2020 over someone who did not.
Of note, Nebraska players are CURRENTLY SUING the Big Ten over this, i.e, claiming “Tortious Interference with Business Expectations.”
Here’s the pertinent language.
Once upon a time the State of Nebraska adopted this NY Sports Lawyer for coming to the defense of the Cornhuskers. Naturally, the entire Lust Household followed soon thereafter.

In light of the NCAA's memo today, it seems like they are in need of a little refresher on the laws of our country. So here it is:
NCAA Law < State Law
That is all. You're welcome.
Per

There are some indications that University Presidents may have simply failed to consult their Boards before voting which may be resulting in a cover up behind the scenes.

dug into the trademark filings. It appears that David is NOT surrendering to Goliath without a fight.
What the Big Ten is saying:
1) Ohio State is more important to us than Indiana.
2) Ohio State is more important to us than Nebraska.
3) We value money more than rules.
4) All of the above.
The Big Ten is expected to change its policy that teams must play six games to be eligible for the conference championship game.
This would likely pave the way for Ohio State to face Northwestern, pending approval in the league, sources told

Here’s some free legal advice for Commissioner Kevin Warren and the

. If you end up re-voting, you’d be best to livestream the deliberations.
Let’s try FULL TRANSPARENCY this time around.
Going to be hard for Antonio Brown and his lawyer to convince people he was physically incapable of playing with footage like this - during the game - and then him running around after he took his jersey off also without any noticeable physical limitation.
I’m not kidding at all. Gavin has a real case here. The good news is that Dr. Pepper has enough money to quickly fix this, do the right thing (pay both!), and avoid the PR nightmare.
Q: How are they forced to go to the team that drafts them?
A 1st Rd Pick once claimed the NFL Draft unfairly prevented him from negotiating a higher salary with other teams. Free agency was more fair, he argued.

Per reports, the NFLPA plans to petition the NFL to release the full findings of the WFT investigation, including emails relating to Dan Snyder.
The players want all emails to be released from what was gathered in the Beth Wilkinson investigation.

When the NFL had a dirty player, Vontaze Burfict, they kept increasing punishment which resulted in a 12-game suspension, the longest ever.
Meanwhile, the NHL opted to hit their serial-offender, Tom Wilson, with only a $5K fine... when his salary is $5M.

Here’s the video of Dave Portnoy’s deposition in the breach of contract lawsuit brought by Michael Rapaport against Barstool.
UPDATE: There’s been an arrest.
Per reports, a 29-year old from Staten Island was arrested for this incident after Game 5 of the Rangers-Lightning series at MSG.
Charged with 2 counts of assault, 2 counts of disorderly conduct, and 2 counts of harassment.

Had a call with lawyer on a case who I heard lived in Nebraska:
ME: Long story but I’m a Cornhuskers fan even though I didn’t go to school there.
HIM: I went to Creighton but still support Nebraska Football.
ME: Ahhhh so you’re a Jaysker!!
HIM: …how do you know what that is?
Seeing many misinformed takes on Michigan alleged sign stealing by people ready to condemn Harbaugh because of the mere **opening** of an investigation. Do you know how crazy that sounds??
What happened to due process?
What happened to innocent until proven guilty?
