UM fans always crack me up when they try and understand bylaws but fail miserably.

So UM by getting aggravated is much more likely to get a postseason ban and a much larger fine. This is my guess as to why in UM’s response to the NOA, that they really hammered “overreach and overcharging” as they didn’t want to be in the “aggravation” category.

What is the difference in punishment outlined for Aggravated vs Standard? Well check out the punishment guidelines…

I would agree with aggravated for based on what we know publicly, but maybe it goes standard and that would be a big win for UM and my guess as to why they are fighting this out.

Well that all depends on whether the COI decides if it Aggravated or Standard?. Intrinsic did a great summary on why it is likely to be Aggravated and not Standard.

@RossDellenger @NCAA @YahooSports @UMichFootball @CoachJim4UM @UMich More evidence backing the Aggravating Factors for Institutions claim by the @NCAA:. Michigan had to convince the COI their case didn’t qualify as Aggravated Level I—.because if it did, harsher institutional penalties (like a CFP ban) would be sanctioned

2 See the violations noted in the widespread. And note that each time they advanced scouted is a violation, so per reporting could be 50+ times and occurred over 3 years. Now what does that mean if UM is facing Level 1 Failure to monitor?.

As you can see below. In order to go to Level 1, UM checks many of these boxes. 1. Widespread (see previous COVID violations, Minter and Clink admitting to knowingly breaking recruiting rules, Denard with a level 1, and Stalions scheme)

Failure to Monitor-UM. Let me start by saying normally Failure to Monitor is normally a Level 2 charge. Based on what we know from reporting and previous cases (see UT public infractions decision) I will explain below how UM is likely to see it as Level 1.
