We are confident that the Court will confirm the longstanding existence of the right to strike under C87 & restore to the ILO, its supervisory system, and members the status quo before the Employers' abandoned consensus in 2012 by offering an incorrect legal interpretation. 8/10

While there is no need to resort to supplementary rules of Treaty interpretation, the travaux preparatoires and the circumstances of its conclusion also confirm that the right to strike is certainly not excluded from the Convention. 6/10

Under the rules of Treaty interpretation, the ordinary meaning of the Convention, interpreted in good faith, in their context, and in light of its object and purpose, absolutely confirms the existence of a right to strike under C87. 4/10

And its a wrap. Day 3 at the ICJ saw arguments from Uruguay, Somalia, Vanuatu, the International Cooperative Alliance and Business Africa. And again, a majority of arguments supporting the position that the right to strike is protected by Convention 87.

Day 2 at the ICJ saw oral arguments from Brazil, Spain, Indonesia, Mauritius, Mexico, Norway, Panama, the UK and Egypt. Overall, a very good result for the right to strike, with 6 for, 1 against and 2 who focused on other matters.

Today was Day 1 of historic hearings before the ICJ as to whether the right to strike is protected by Convention 87 of the International Labor Organizations. The clear answer to the questions is yes.
