In case you missed my testimony last week, here you can find my opening statement.
In 5 minutes, I lay out the limits on presidential authority to "shut the border" and call on Congress to stop kicking the can down the road and fix our asylum system.
This is bad. ICE just told students here on student visas that if their school is going online-only this fall, the students must depart the United States and cannot remain through the fall semester.
There is literally a crystal clear provision of the Constitution that says no state may refuse an extradition request from another state. So what DeSantis is saying here is that he plans to openly defy the Constitution.
The weaponization of the legal system to advance a political agenda turns the rule of law on its head.
It is un-American.
The Soros-backed Manhattan District Attorney has consistently bent the law to downgrade felonies and to excuse criminal misconduct. Yet, now he is…
In the video, a mom and her two small children wade across the river and calmly walk up to a waiting law enforcement officer, who points them towards the processing area.
There is no definition of the word under which this is an "invasion."
Some important context for this. ICE actually runs a major portion of the student visa program, what's called the "Student and Exchange Visitor Program (SEVP)." So oddly enough it's ICE, not US Citizenship and Immigration Services, that sets rules for students.
And of course, as
@AbayaMiriam
points out, many foreign students come from countries where internet connections might be very spotty, or where US classes might be held in the middle of the night local time. Just going home won't work for those students.
@ReichlinMelnick
What if students are going back to countries without good internet connection? Or where the time difference makes it difficult to join classes online? This makes it so difficult for these students to continue to get the education they paid for.
The number one cause of death for Border Patrol agents this year was COVID-19 (13 deaths), followed by car accidents (2 deaths). Yet the union fought against the vaccine mandate as “tyranny.”
More agents died of COVID-19 than have been victims of homicide in the last 75 years.
More Border Patrol Agents died in the line of duty during 2021 than in any other time since the agency’s inception. The line-of-duty deaths of 15 Border Patrol agents mark a grim milestone in the agency’s history.
Meanwhile, while all this trolling goes on by Rep. Boebert and the right wing, the Biden administration has quietly been extremely effective over the last month at getting kids out of Border Patrol custody.
The number of kids in Border Patrol custody has dropped 82% in a month.
Rep. Boebert trolls Biden with a mylar blanket during national address
Biden didn't even address the real crisis and refuses to go down to the border. He's just continuing to play politics.
@laurenboebert
Under the rule ICE announced today, schools like Harvard wouldn't lose tuition from students forced to leave the United States. Students could "attend" classes virtually—in their home country.
But if the choice is stay at Harvard or leave the US... many will choose to transfer.
At no point since the Border Patrol was created in 1924 has the United States been able to reduce crossings to zero. Never. It is impossible. In fact, no nation in human history has ever been able to stop every unlawful border crossing—not even North Korean or East Germany.
Calling Border Patrol officers "men and women in uniform" as if they're troops fighting in Iraq, when in reality they won't identify themselves when they're grabbing people off the street in Portland out of their rented vans.
DHS is out of control and Chad thinks he's Patton.
Another great point as to why students may not be able to attend classes in their home countries. Many of the resources that professors will rely on for online-only curricula are not available in every country. Some students could be locked out of tech.
1. There is no country of "Timor." It's "Timor-Leste" or "East Timor."
2. Do you know why Timor-Leste had a visa overstay rate of 100%? Because a grand total of ONE PERSON from Timor-Leste came to the US in the relevant time period, and that one person overstayed.
100% of guestworkers from Timor overstay their visas.
This may be a small number of people, but why is a country with a 100% overstay rate allowed to participate in guestworker programs at all?
This is one of THE reasons why people voluntarily migrate; because one person can lift an entire family out of extreme poverty. By coming here, his family in Honduras could run a small business and his 12 nieces and nephews could go to school instead of work.

- He’s DHS Acting General Counsel
- His wife is a federal judge
- One law school friend and groomsman is Deputy General Counsel at DHS. Another has a DOJ job.
The Senate just confirmed 33-year-old Kat Mizelle, a Jones Day associate and ex-Thomas clerk, to a federal judgeship in Florida. The ABA gave her a "not qualified" rating due to lack of trial experience.
Out of Trump's young judges, she's the youngest.
The Biden admin physically removed more migrants from the US than any administration in history.
There were almost 2.5 million Title 42 expulsions under Biden. That's 35 times as many expulsions as people put into Remain in Mexico under Trump.
That's open borders, apparently?
Lots of people are asking whether schools could adopt some form of hybrid system where they only hold a tiny fraction of classes on campus, and the answer is, it depends. Here's what ICE says on "hybrid" models, with some in-person classes and some online.
Wow. In MIT/Harvard case, DHS has fully agreed to rescind the July 6 ICE guidance and July 7 FAQ, and rescind all implementing guidance!
So no TRO, because the government backed down completely.
So it seems like Florida gave
@FoxNews
an exclusive, but didn't tell anyone in Martha's Vineyard, or even tell the migrants where they were going.
This has enormously damaging implications for the migrants, who will have to leave the island for court hearings and check-ins.
I remain fascinated with the fiction that Trump delivered "the most secure border in our nation's history."
The Trump admin released 1.1 million migrants in 4 years. He left office with crossings having risen for months. His last December was the worst December in 20 years!
This Joe Biden/Chuck Schumer Open Border Bill is an absolute non-starter and will further incentivize thousands of illegals to pour in across our borders daily.
House Republicans have already passed HR2 - the Secure Our Border Act, which would actually secure the border and…
Another major problem is that many countries have blocked travel from the United States right now—because we're a COVID hotspot.
It's unclear how many countries applies those rules to their own citizens, but some definitely do. What are those students suppose to do?
This is “almost never mentioned” because it’s a straight lie.
The ONLY thing in the bill that impacted paths to citizenship was the inclusion of the Afghan Adjustment Act to allow Afghans who came after the fall of Kabul to get green cards—after multiple years of vetting.
Under DHS's new proposed rule, if you were born in, or are a citizen of, one of the countries on this map, you would be banned from getting a four-year degree in the United States, with a student visa limited to two years maximum.
The thread has all the countries.
Under DHS's new proposal, citizens or people born in the following countries would be banned from getting student visas longer than 2 years:
- Afghanistan
- Benin
- Bhutan
- Burkina Faso
- Burundi
- Cameroon
- Central African Republic
- Chad
- Congo (DRC)
- Congo (ROC)

Ah, the immigration Catch-22s; if a migrant is well off they can't be seeking asylum, but if they're poor then they're economic migrants.
Also, China is a dictatorship that represses its people so everyone should want to leave, but any Chinese migrants seeking asylum are spies.
WOW. It gets even worse. “Perla” lied to dozens more asylum seekers, put them up in a hotel for days with false claims about jobs and housing, and when DeSantis suddenly cancelled the Delaware flight yesterday, she dumped some back at the shelter and stranded the others.
BREAKING: DeSantis-linked operation in TX had planned to fly migrants to Delaware yesterday. Then they pulled the plug –– to "punk" the media, the Gov. said –– and 20+ people were left at a hotel. /w
@NickNehamas
Beginning this moment, Texas law enforcement officers can arrest any person in the state they believe crossed illegally. And judges can now order people to walk back into Mexico at threat of 20 years in prison if they don't—even if the person has federal permission to be here.
This is a MASSIVE and DANGEROUS change.
Now, if ICE believes someone is undocumented and has lived in the US for less than two years—with the burden on the immigrant to prove otherwise—they can deport that person within days, with almost no court review allowed.
BREAKING: Expedited removal to be expanded to apply everywhere within the U.S. (not just 100-mile border zone) and to anyone not in the U.S. more than two years. Federal Reg Notice will be published tomorrow.
Wild to me how many people laughing at Buttigieg in the replies think he's making this up and apparently have never heard of Robert Moses.

Under his new plan, a mom who drove her undocumented kid to school could be guilty of a second degree felony (same as vehicular homicide) and could be sentenced to 15 years in prison.
Everything I’ve heard over the last 24 hours supports the reports that the White House has agreed in principle to what could be the most anti-immigrant and anti-asylum legislation in almost 30 years.

Wow. Massive asylum restrictions is right. This bill appears to ban asylum for Central American Minors who try to apply at the US border! It says that if you're a CAM, you MUST apply in your country or you are ineligible for asylum. And then the bill sets a cap!
Undocumented immigrants are 3% of the entire US population and many of them are essential workers and yet this basic common-sense proposition is somehow controversial.
The Third Circuit granted him a stay of deportation at noon. But that night, ICE agents came to deport him anyway. When he pled with them to honor the stay, they called him a liar and didn't check for it. And when he refused to move, they beat him up—in the middle of JFK airport.

A couple final things to add to this thread.
First, current regulations already blocked online-only course work, so ICE will place the blame there. But
@DHSgov
could have chosen to amend those regulations given the unprecedented emergency we find ourselves in. They chose not to.
Holy crap. This is genuinely an incredible scoop from

ICE does say students, rather than leave, could "take alternative steps ... such as a reduced course load or appropriate medical leave."
But RCL is only available for:
- Academic difficulties;
- Medical conditions; and
- Completion of a course of study.
It won't apply for most.
The world’s most gullible celebrity is taken in again.
The program is not secret at all. People in the US with friends/family in certain countries can file an application with

to sponsor that person. If approved, the person has to buy a plane ticket to come. That’s it!
“Shipped to New York” lady they bought plane tickets! Same as you! Their families and friends likely paid, or they used the last of their savings to buy the tickets themselves.
It’s a free country and they are legally permitted to be in it while they go through a process.

When I asked a Delta representative if this was the case, his response was “What does it matter, they’re humans too”
What is happening????
Finally, take today's decision to kick students out of the US if their school goes online-only into context with other recent attacks on legal immigration in the name of COVID.
Just last week Trump expanded a ban on most legal immigration through Dec. 31.
Speaking on a purely personal basis, this is one of the most disgusting ways to respond to mass shooting yet. One of the victims was 8 years old. And he can’t even acknowledge their basic humanity

🚨Don't let this be buried in today's Coronavirus news: the GAO just issued a public report today confirming that we will likely never know how many children were separated by the Trump administration.
Report is here:
It's incredibly worrying that the Border Patrol union—the people in charge of caring for babies in custody at the border—is calling for permission to starve the babies.
The union used to tout the "humanitarian" work their agents did caring for babies. Now they want them starved.
Making matters worse, within less than 30 days,
@USCIS
, the agency which administers the entire US legal immigration system, is set to run out of money... and the Trump administration has yet to submit a formal request to Congress for emergency funds.
Study after study has proven that undocumented immigrants commit crimes at lower rates than U.S. citizens.
Statistically speaking, you're measurably safer living in a town filled with average undocumented immigrants than a town filled with average native-born citizens.
261000 illegal immigrants have committed some 430000 crimes including 800 homicides, 800 kidnappings, & 5000 assaults in last decade in Texas… and our border has never been more exposed & dangerous.
#EndBorderCrisis
More Border Patrol agents died from COVID-19 than had been the victims of homicide in the last 75 years (in the post-Prohibition era). And yet the Border Patrol union called the vaccine mandate tyranny.
301 law enforcement officers died of Covid-19 ‘in the line of duty’ in the US last year, nearly 2x as many as for all other causes, at a time when effective vaccines were widely available, but the right wing police unions had set their faces against them.
And it begins—NPR uses an inflammatory picture of a caravan that was broken up days ago for a story about a deportation moratorium that only applies to those here months ago and a policy reversal that wouldn't have affected almost all of the caravan even if they had made it here.
You're not going to believe this, but Bill Maher is not an expert on immigration law and he really, really does not know what he's talking about here. Again, until very very recently (within the last year), there was widespread bipartisan agreement that Congress needs to act.
Wow even Bill Maher is calling Biden's bluff on illegal immigration:
"The president can fix this. He already has the existing laws. This is all so silly. I need a piece of paper from Congress to deal with the border. No, you already have that."
Johnson: We also advanced cuts to some of the agencies that have been turned against the American people. We are going to cut 3% from DOJ, 7% from the ATF, 6% from the FBI, and 10% from the EPA.

ICE is trying to hide the coronavirus outbreaks raging through detention centers.
Another thing to watch for? ICE may try to hide deaths by "releasing" people in comas and on ventilators at a hospital. Once "released," the death is no longer "in custody." They've done it before.

@MiamiHerald
We
@immcouncil
wrote a special report on every major policy change that's happened since the pandemic began, and we'll update it ASAP with this new decision on student visas.
Our report reveals extensive changes across the entire immigration system.
Since October, Border Patrol agents have arrested 198 members of dangerous gangs and transnational criminal organizations, keeping them out of your communities.
This includes members of MS-13, 18th St, Paisas, and Surenos, just to name a few.
It's kind of stunning how much the legal cannabis market has effectively wiped out cross-border marijuana smuggling in barely a decade.
In fiscal year 2013, Customs and Border Protection seized 2,900,118 pounds of cannabis. This year, it's on track to seize under 225,000 pounds.
This is a truly excellent piece, with a sobering line buried in it.
“For the first time since World War II, the U.S. government is turning away thousands of asylum seekers regardless of their need for refuge.”
That's about 1 charge every 4 days on average over the last 18 years. But funny, I don't see Fox News running "COP CRIME" segments like they run "MIGRANT CRIME" segments.
1,800 cops charged with child sexual abuse in the last two decades, targeting mainly teen girls they encountered as a part of their work, according to the Washington Post.
The Post leads with a teen girl assaulted by a cop who was processing her rape kit from a different assault
About half of all farmworkers in the US are undocumented. The people some are calling for mass deportations to target are literally the people ensuring that you have food on your plate.

! We just learned that after the Border Patrol “assisted” this woman, they took her to the hospital where her baby went into the NICU.
Then, hours after she gave birth, the Border Patrol threw her in a jail cell and are threatening to send her to Mexico without her baby—tonight!
Finally, I would be remiss if I didn't mention that all 50 refugees who were sent to Martha's Vineyard today are reportedly Venezuelan.
Last year, DeSantis designated a "Victims of Communism" day in Florida.
Guess Venezuelans don't matter to him anymore.
A lot of the media figures on the right who routinely post about random undocumented immigrants committing crimes have been conspicuously silent when it turns out that the victims of the Baltimore bridge collapse were undocumented and, by all reports, incredible people.
ICYMI, yesterday we got some definitive statistics on what percent of migrants are testing positive for COVID, and we learned two things:
1) The test positivity rate is *lower* than the state of Texas as a whole, and;
2) 90% of migrants are voluntarily getting vaccinated.
Several days ago, Ted Cruz blamed migrants for rising COVID cases in South Texas.
Well, newly-released data from one of the largest migrant shelters in South Texas not only conclusively disproves that claims, but also shows that 90% of migrants have voluntarily gotten a vaccine!
Kudos to Bill Hagerty for forcing a vote on this amendment.
Last night every single Democrat voted to ensure illegal aliens continue to receive congressional representation. It's a disgrace, especially after Biden decided to flood the country with 10 million illegals.
Any gay Mauritanian has a slam-dunk case for asylum. The country makes gay sex a capital crime punishable (theoretically) by stoning to death. Gay Mauritanians have been thrown in jail and persecuted in many other ways.
We can still be a beacon of freedom for people like him.
BREAKING: Another Border Patrol bus full of illegal immigrants, this one all adult men, just pulled up and mass released them onto San Diego streets. Again, men from all over the world going to blue cities. One man from Mauritania told me he is gay and is here to request asylum.
After Texas spends tens of thousands of dollars per person jailing, trying, and then incarcerating each migrant, they’ll be sent to ICE where they’ll no longer eligible for expedited removal and will have to be put through full immigration court proceedings. Can’t make it up!
A huge change in procedure in Eagle Pass. Texas is now immediately arresting migrants if they cross the razor wire in Shelby Park. For years, migrants could walk right in, be processed by Border Patrol and released.
Can confirm. ICE went a client's home wearing shirts that said "POLICE."
They showed his teenage niece a picture of a random man they said had stolen her uncle's identity and had her call him to come home.
When he got home they arrested him in front of her. She was traumatized.
NYT provides further context on how "ICE agents must wait for their targets to come outside of their homes voluntarily to arrest them", but use tactics like "carry decoy photos, holding them up to the windows... pretending to be looking for someone else.""
Final final: one of the people flown to Martha's Vineyard said that while in Texas, a "refugee organization" told them if they got on the plane they'd get "work and housing."
If true, they were lied to. That could be fraud. DOJ should investigate.
Just going to point out as always that this is a shameless lie. Biden inherited a complete mess at the border. Border encounters in December 2020 were the highest level for a December since December 1999 and had been rising for months due to Title 42's impact on repeat crossings.
This would be like a president ordering the government to reimpose slavery, or deliberately quarter troops. About as flagrantly unconstitutional as you can get.
Donald Trump plans to end birthright citizenship by ordering government officials to cease issuing Social Security cards and passports to the children of undocumented immigrants born in the United States
“We are extremely bad at our job” isn’t really the argument you’d think the head of a law enforcement union should be saying out loud, but hey, what do I know.
Peep the juxtaposition of the chyron, which is about run-of-the-mill cocaine smuggling which has gone on at ports of entry for decades, and the *completely unrelated* photo of migrants seeking asylum between ports of entry.
The goal is to falsely conflate migrants with drugs.
With Roe v. Wade overturned, multiple states have now fully banned abortion; their trigger laws took effect instantly, at 10:10AM today when Justice Alito's decision was issued.

claims Biden “already has” authority “to ‘shut down’ the border ‘when it becomes overwhelmed.’”
Except Biden doesn’t. No such authority exists. The right to seek asylum can’t be so easily tossed aside.
The man who broke the border says the border is broken, and he is the one to fix it. He wants the authority -- which he already has -- to 'shut down' the border 'when it becomes overwhelmed.' Even if he used it, which he likely would not, because he hasn't used the authority he…
Actually, one final tweet: I commend the people of Martha's Vineyard, who when faced with a surprising situation, stepped up immediately to offer support and are responding with a lot more moral strength than the people responsible.

Funny, don’t recall him doing much soul searching after the El Paso massacre, where a shooter *directly cited* the same invasion language that Vance himself has repeatedly pushed.
We're still learning about the horrific shooting in Nashville. But if early reports are accurate that a trans shooter targeted a Christian school, there needs to be a lot of soul searching on the extreme left. Giving in to these ideas isn't compassion, it's dangerous.
I looked at two and a half years of fentanyl seizures at the southern border publicly reported by CBP through its official media channels.
Out of more than 500 incidents, just 8 involved catching fentanyl being brought across the border on foot between ports of entry.

WOW. I have to admit that I didn’t predict things escalating this quickly. Lankford may have been able to get the GOP the harshest changes to immigration laws in decades after Dems seemed poised to cave—and now he may be excommunicated for it.
News: The OKGOP passed a resolution saying they “condemn” JAMES LANKFORD and his work on bipartisan border security package and until he stops they don’t support him
“Until Senator Lankford ceases from these actions the Oklahoma Republican Party will cease all support for him.”
Now that the bill text is out, Democrats should see almost immediately that the President's claimed "compromise" is a complete joke. This bill would be one of the single-biggest dismantling of America's systems of humanitarian protections ever. It's Stephen Miller's dream bill.

talked to the husband of Diana Velasquez Alvarado, who died in the shooting. Turns out she had a green card.
So Abbott not only needlessly brought up immigration status to smear the victims, he did so falsely!
Feels like Abbott must apologize.
I just spoke to the husband of one of the victims. He confirmed to me that his wife was a permanent resident of the US. He even sent me a picture of her ID confirming this.
But I guess to Greg Abbott, anyone who is from another country is an ‘ilegal immigrant’. Shameful.
