To exclude NHS acute providers from merger control, would need to move to a spillover market (like NHS mental health) where private providers can only be chosen if no capacity at local NHS acute trust. Whether this is in best interests of patients is another matter (2/2).
Good blog by @mbirty. Removing merger and competition rules from NHS not straightforward when patients can choose between NHS and private providers. Unlike Scotland & Wales, NHS in England depends on private sector capacity (1/2)
