The Mental Health Bill (to amend the Mental Health Act 1983) has had its 3rd reading in the House of Lords, and so it now moves to the House of Commons for MPs to debate and amend. You can follow progress here👇.

Mental Health Bill reaches report stage in the Lords on 31/03 and 02/04. Some new amendments include people other than police using powers under ss. 135 and 136, and tweaks to the complicated Nominated Person provisions. Follow some of the progress here:

“The number of people during 2022 -2023 detained under the Mental Health Act across England were 51,312.”.This is not correct; that figure published by NHS Digital, is the number of detentions; one person could account for multiple detentions during the course of a year.

“Admission via an emergency section. to identify whether the requirements of section 2 or section 3 are met, in which case the s.4 will be converted to the relevant section, either 2 or 3.”.'Conversion’ is only possible to s.2. S.3 would mean starting again and ‘regrading’.

“In the case of an emergency, the application may be made by the nearest relative of the patient or a medical practitioner under section 4 of the Mental Health Act.”.A medical practitioner cannot make an application (NR can also make app for ss. 2 and 3).
