Judge Michael Scudder put it plainly to the prosecution: The government made the error - then placed the burden on Shah to "figure out the consequences" and "sort it all out." "How is that a fair or proper outcome here?"🧐 Good question.

DOJ restrained funds it couldn't trace to any fraud - over $10 million in untainted assets. That was money the founders needed to pay their lawyers💼. The government later admitted it broke the law🥱. But by then, Shah had already gone to trial without the lawyers he wanted.

The original prosecutor on this case, after being forced by the judge to take the stand, testified he "knew that I didn't know the law well enough"🤷🏻‍♂️on forfeiture. The DOJ seized millions anyway.

The problems here are extraordinary. Judge Easterbrook pressed the DOJ attorney on why the government's "admitted asset over-restraint" shouldn't require reversal.

The government seized the founders’ assets illegally so they couldn’t afford their lawyers. Then, for the sake of putting two self-made entrepreneurs in jail, they offered immunity to the actual fraudsters, scripted their witness testimony, and pinned the blame on the founders.

This followed a Wall Street Journal article highlighting that a sales executive had been inflating numbers at Outcome, then one of Chicago's most prominent startups. The ongoing fight led to the founders getting jail time amidst a range of legal controversy.

In 2019, the DOJ brought criminal charges against Outcome Health founder Rishi Shah, after Illinois governor J.B. Pritzker's venture capital firm sued the company to retrade terms of their investment.
