Fred's work on generalization was so insightful, emphasizing that equality sometimes requires treating different things the same. His book "Profiles, Probabilities and Stereotypes" had a big impact on my thinking. Such a generous colleague and friend. I miss him already.
Prof. Frederick Schauer — a “giant” in the legal academy who influenced scholarship on freedom of speech, constitutional theory, evidence and jurisprudence — has died. #UVALaw community members remember his life and work.

Looks super interesting. So glad @VirginiaLawRev is publishing it.
Excited to say that my article Deterring Unenforceable Terms will be coming out in the @VirginiaLawRev. It builds on the great empirical work on unenforceable terms in recent years, focusing on the normative case and policy details for affirmative penalties for contract drafters:

I don't know how I missed this. Thanks @lsolum for the "highly recommended, download it while it's hot" recommendation for my article "Diversity by Facially Neutral Means" -- which is here: https://t.co/3Hjnc0B64l and forthcoming from @VirginiaLawRev

I am also so grateful for the generosity of the family of Theo Danzig. May his memory be a blessing.

I couldn't be prouder. Julianna has wrestled with such an important topic in such a thoughtful way. @BowdoinCollege
A fellowship fund honoring the legacy of Theo Danzig, a member of the Class of 2022 who died in late October 2021, held its inaugural lecture in February. With Theo’s family in attendance, Julianna Brown ’24, the first recipient, presented her research.

I fully agree.
I'm so dismayed by Liz Magill's resignation and I so hope that Claudine Gay @Harvard will not follow. I fear too few of us have said what many of us think: She did nothing wrong, & the real failure of leadership would be surrendering to a campaign so hostile to our values. /1

Nice piece by @NoahRFeldman. Is a call for genocide allowed under free-speech rules? It really does depend on the context, argues @NoahRFeldman, even if all such calls are repugnant https://t.co/nDUOPdZQE2 via @opinion
