As I told @BLaw: “the President is ‘innovative’ for using the technology to announce his judicial nominees directly to constituents, even at odd hours. The government doesn’t stop working when we go to sleep. And, you know, I don’t think that’s a bad thing to remind people of.”

In today's dissent from denial in the much-relisted Veneno v. US, Justice Gorsuch, joined by Justice Thomas, note the incongruity of the Indian Commerce Clause being interpreted as plenary regulatory authority over tribes when ... it's the same language as the Commerce Clause.

Will listen to this @DavidLat podcast with Ken Feinberg. I spent a fair amount of time with him years ago while developing a play about his stewardship of the 9/11 compensation fund (that's the poster on R), and he was very generous with his time. He's also hardly aged!
