The court erred by treating lobola as marriage. In Zulu culture, lobola is an engagement, while marriage is confirmed only after ukuthelwa ngenyongo and umgcagco. Courts should not redefine customary law using Western standards.
The ConCourt has upheld section 10(2) of the Recognition of Customary Marriages Act, confirming that a civil marriage concluded after a customary marriage defaults to in community of property unless a Prenup was signed prior to the civil marriage. What a win for Black Coffee!
