It has been a challenging time for my wife and me. Last month, we lost our baby boy. It has been one of the most painful experiences of our lives. In the midst of grief, my wife wrote a letter to mothers who have experienced the same unimaginable loss. She asked me to share it.

You can read our @CatoInstitute brief by @bskorup, Alex Xenos, and me urging the Court to overrule Humphrey's Executor and strike down the removal restrictions here: https://t.co/GLzFFT7tkO

Removal protections for executive officers unlawfully expand the power of the administrative state.

Excellent post @VolokhC by Prof. @IlyaSomin, which references our amicus brief. https://t.co/WF7I5D003r

In this post, I urge the Supreme Court to hear case of Canna Provisions v. Bondi, and use this opportunity to reverse its awful decision in Gonzales v. Raich (which egregiously expanded federal power, and authorized awful War on Drugs abuses):

As James Madison explained in Federalist 45, a foundational principle of the Constitution is that the federal government has only the “few and defined” powers the Constitution grants it. One of those powers is the authority to regulate interstate commerce. But decisions like

We at Cato filed an amicus brief in Canna Provisions v. Bondi calling on SCOTUS to grant cert, restore the Commerce Clause to its original meaning, and overrule Gonzales v. Raich.

The Supreme Court should overrule Gonzales v. Raich and restore constitutional limits on Congress’s power to regulate purely intrastate activities.

Oral argument for Rutherford v. US at SCOTUS is today. Check out Cato’s amicus brief, arguing judges may consider sentencing disparities created by FSA when deciding compassionate release motions.

The First Step Act of 2018 has been hailed as the most significant criminal justice reform bill in a generation.

Last week, the Cato Institute filed an amicus brief I coauthored in Trump v. Slaughter, urging the Supreme Court to reaffirm the President’s constitutional authority to remove executive officers and overrule Humphrey’s Executor. Read the brief here:

This is an amazing tweet. This couple chose to retire early, in their early 50s, on a $127,000/year government pension. They already get $5,500/year in subsidies for health insurance, and they want $15,000/year instead. And this is supposed to thrill me?
Early retirees like Bill & Shelly will see their health insurance premiums increase nearly 300%—from $442 to $1,700 per month if Congressional Republicans refuse to extend the enhanced tax credits. That's an extra $15K a year families can't afford. https://t.co/Uvo6sYi7YR

The Eighth Circuit actually went further. It ruled that judges can excuse an officer’s mistakes based on facts he did not know at the time he used force. And it effectively held that any time police encounter an armed individual, deadly force is reasonable as a matter of

In this case, Milton Green was shot by police outside his own home—then denied a jury trial on whether the shooting was “reasonable.” Both the district court and the Eighth Circuit treated the officer’s supposed “mistake of fact” as a question of law for judges, not one of fact

Last week, @CatoInstitute filed an amicus brief I co-authored in Green v. Tanner, urging the Supreme Court to restore the jury’s vital role as a check on government power in excessive-force cases. Read the brief here:

Displacing the jury’s role undermines the justice system prescribed by the Constitution. American juries were conceived as a critical check on government power.

I think Jimmy Kimmel is an enormous jerk whom ABC should have yanked off the air of their own will. But Brendan Carr has made that impossible. This doesn't end anywhere good.

Let’s separate two things. Jimmy Kimmel is an unfunny mediocrity and his take on Charlie Kirk was tasteless, stupid and factually vacant. At the same time the chairman of the FCC should not be programming late night television. That’s a violation of the first amendment.
