New (little) paper: Federal courts aren’t supposed to engage in “abstract review” of government policies, but something like it is happening in district courts anyway. If that’s a problem, maybe try one of these off-the-wall proposals to centralize abstract review. Link below.

Our findings offer context for those who support the President's indefeasible removal power and those who do not--with removal protections, the President is legally prevented from removing officers precisely when one side stands to gain a partisan advantage from doing so.4/

stop the President from removing officers. We find that historically the statutory restrictions have not done very much (rather, sub-statutory norms protect officers). However, the statutory restrictions do come into play when those norms breakdown, particularly concerning 2/
