Great thread. Trump's use of tariffs is a wild departure from convention. But it looks less radical if you classify it as one of the many national security powers that successive presidents have wielded without serious constraint or oversight.

1. Politically, the key thing to understand is tariff crisis is above all else a constitutional crisis. Under USA constitution, power of tariffs belongs to congress, not president.

Even before "liberation day," there was good reason to fear that rules-based trade cooperation is in danger of being replaced by power projection. We need more counterexamples of countries constructively resolving trade tensions arising from major geopolitical & economic shifts.

like, a court could easily find "liberation day" unsupported in the text of IEEPA, and even if not Congress could amend the law to exclude trade measures and it would allow the law to be used as it has been between 1977 and 2024.

I feel like it's not sufficiently appreciated that the administration is seeking to rewrite the terms of global trade using a law that before January had never been used to impose tariffs and that makes no reference to duties or import restrictions .
