Stoughton responds by saying officers can still make mistakes, but they must in the range of what is "professionally appropriate." Stoughton says Grayson threatening to shoot Massey in the "f*** face" was not an appropriate warning in that situation.

Wykoff is suggesting Sang. Co.'s use of deadly force policy allows for some "margin of error" for officers to make mistakes. He also cautions against analyzing Grayson's actions, with the "benefit of 20/20 hindsight."

Stoughton testifies: Massey's shooting was caused by Grayson's "professionally inappropriate" actions.

But, Stoughton says Grayson's actions were "tactically unsound." He says Grayson should not have pulled his gun on Massey, as her behavior at that point wasn't "threatening." He also should have created distance when she had the pot in her hands.

He says Massey can be seen ducking behind the kitchen counter with her hands in the air when Grayson points his gun at her. As he moves toward her, Massey can be seen grabbing the pot and raising it over her shoulder. She is shot before she could throw it at Grayson.

The prosecution played the police body cam footage - frame by frame - in court. Stoughton analyzed the moments Grayson pulls his gun and fires at Massey, after telling her to move a pot of boiling water from the stove.

Stoughton: Miss Massey's behavior suggests no intent to harm, when she tells Grayson, "I rebuke you in the name of Jesus."

Stoughton says Grayson made a series of decisions the night he shot Massey that were "tactically unsound." Specifically, drawing his gun, threatening to shoot Massey "in the f** face," and advancing toward her.

Stoughton says the tactical path an officer takes leading up to a shooting matters. "If you select different path you could potentially improve the outcome. Tactics can improve officer safety, as well as a community member's safety."

Judge Ryan Cadagin has overruled the objection. He says it's relevant for officers to "know what generally-accepted practices are." Stoughton's testimony continues.

The defense is now objecting to Stoughton's testimony. Dan Fultz says it might confuse jurors to hear Stoughton discuss generally-accepted police policies, rather than the Sang. Co.'s policies that we KNOW Grayson is trained on.

Stoughton has testified in the criminal prosecutions of Derek Chauvin, who was convicted for killing George Floyd, as well as Kim Potter, who was convicted for killing Daunte Wright.

Stoughton has testified in dozens of cases on police use of force and tactics. He's reviewed the body cam footage of the night Sonya Massey was shot. His goal was to see if Grayson's actions align with generally-accepted police tactics.

Mark Wykoff with the defense team questioned Dekmar for a while. He was trying to make the case that Massey did, in fact, pose a serious threat when she held up the pot of boiling water. Whether or not she threw that pot is in question - and will be up to the jury to decide.

Dekmar says Grayson violated police policy when he failed to use de-escalation tools that he received 40 hours of training on. He noted the way Grayson spoke to Massey leading up to the shooting, saying his tone of voice was commanding.

Dekmar is now being questioned by the prosecution as an expert witness on police training and policy. Dekmar has reviewed body cam footage from Grayson, his partner deputy Dawson Farley, the incident reports and Sang. Co.'s policies on use of force, and crisis intervention.

Mark Wykoff, representing Grayson, is now cross examining Dekmar. Wykoff is listing off dozens of cases where Dekmar had served as an expert witness. Wykoff is making the point that Dekmar has not testified in a criminal trial or in front of a jury.
