New: Kevin Morris' attorney sent a letter to Oversight Chair James Comer saying he's misrepresenting Morris' testimony from a closed-door deposition yesterday, per a copy of the letter obtained by POLITICO.
Also asking Comer to release the transcript:
Manchin asked if there’s a point where he would change his mind on the filibuster.
Turns around to yell, “NEVER”
“Jesus Christ! What don’t you understand about never?”
The Senate basement, a scene:
Shelby-Burr got off a train together
Burr, navigating through a crowd of reporters: “Shelby has news! Shelby has news!”
Reporters crowd Shelby.
... Shelby does not have news.
Pomerantz’s opening statement in Judiciary deposition:
“I will not be answering questions that relate to my work in the DA’s office, my book or public statements I have made in the past”
McConnell says he wasn't been to the White House since August 6:
"because my impression was their approach to how to handle this [the coronavirus] was different from mine"
Scoop: Jim Jordan is subpoenaing Bank of America as part of a probe into information sharing between financial institutions and federal law enforcement in the wake of Jan. 6:
Reminder: Jordan also subpoenaed Citi earlier this year
House GOP increasingly acknowledging they don't have the votes to impeach Biden:
Bacon estimated 20-30 are not in favor "mainly because it smells bad what he did, it looks bad, but when you ask them what crime is committed — they can’t tell you"
Burr statement:
“It is truly a sad day for North Carolina Republicans. My party's leadership has chosen loyalty to one man over the core principles of the Republican Party and the founders of our great nation.”
INBOX: NCGOP Central Committee Unanimously Votes To Censure Senator Burr
NC GOP Central Committee "voted unanimously to censure Senator Richard Burr for his vote to convict former President Trump in the impeachment trial which he declared to be unconstitutional"
👀 Roy calls the deal a "betrayal of the power sharing arrangement that we put in place" among House GOP
Adds if he can't kill it in Rules Committee or on the floor "then we're going to have to then regroup and figure out the whole leadership arrangement again"
Roy (in Glenn Beck interview) says he is meeting with GOP leadership today re: debt deal
Roy also urging listeners to call their members and urge them to vote no: "We can still kill this and start over and do the right thing"
Inbox: U.S. Sen. John Kennedy (R-La.) announced today that he will file legislation after recess to ban the immediate family members of senior U.S. political officials from profiting in Ukraine.
INBOX:
A staff member in Senator Maria Cantwell’s Washington, D.C. office has tested positive for COVID-19. The individual has been in isolation since starting to have symptoms.
House Dem whip notice:
“Members must remain on the Floor until the Election for Speaker of the House is completed and until directed otherwise by the Whip's office. Members must contact the Whip's office immediately if they expect to be absent at any time”
Gimenez, leaving the meeting between McCarthy, McHenry, Jordan and the hold outs, said no minds were changed and that Jordan was encouraged in the meeting to drop out.
(He did not say who in the meeting encouraged him to drop out.)

: A Speaker Johnson’s staffer told a group of GOP staff today that he opposes warrant requirement amendment at the center of this week’s 702 debate, per two people familiar
Both expect Johnson to deliver this message in other meetings this week

NEWS w/
@kyledcheney
: House GOP announced it was expanding access to Jan. 6 footage ~a month ago—but a series of interviews, previously unreported letters and court filings point to lingering tensions over that decision with the Capitol Police.
Jim Biden telling congressional investigators this morning: "I have had a 50-year career in a variety of business ventures. Joe Biden has never had any involvement or any direct or indirect financial interest in those activities"
full opening statement:
A House vibe:
I joked to McHenry that he wasn't wearing a bow tie.
He said he had it in this jacket pocket (and pulled it out to prove it) but wasn't wearing it because he had already given up on today.
News: House GOP plotting back-up plans on supp:
Fitzpatrick told me he’s working on a bill with Dems that will be a “combination of things that are urgent” including Ukraine and the border
Bacon also part of a group talking about Ukraine military aid
It is my great pleasure to welcome

as our newest congressional reporter. She prowled the halls of the Capitol too well — the team simply had to snag her.
But that’s not all…
Special Counsel David Weiss told members of the Judiciary Committee (and their staff) behind closed doors today that he is "the decision-maker" in Hunter Biden case.
Reiterates he first requested special counsel status in August. More 👇
Indivisible calling on Pelosi to cancel the recess: "cancel recess, and get to a vote on articles of impeachment as soon as humanly possible."
Congressional reporters just trying to survive this week: 😭😭😭
scooplet: House Dems requesting Oversight hold a hearing on Jared Kushner's foreign business deals:
Republicans already signaling it's not going to happen, but could be an area of interest for Dems next year if House flips.
News: House Intelligence Cmte released interview with NARA officials re: handling of classified docs and the presidential transition
They delved some into how they realized Trump records were missing, plus a broader sweep into how records are boxed up:
News: Rep. Adam Schiff (D-Calif.) gathered with some of his fellow Democrats in the Capitol on Friday to discuss planning for a possible leadership bid this fall, per
@sarahnferris
Ahead of this week’s 702 debate:
Warren Davidson dropping these off at offices and handing them out, per a photo sent to me
Note asks members to wear the pin.
It appears the Capitol Police Board has designated all Jan. 6 CCV footage as "security information," per a court filing from USCP general counsel (h/t
@kyledcheney
). This is a request the Capitol Police has previously disclosed it made to the board.
Updated w/statement from Raskin, who appears to draw link between Wednesday moves by Comer/Grassley and Giuliani's Russia/Ukraine actions in the lead up to and during the 2020 election:
News: Comer has subpoenaed the FBI for June 2020 documents, which (according to him and Grassley) include "an alleged criminal scheme involving then-Vice President Biden and a foreign national relating to the exchange of money for policy decisions"
Report spawns from lengthy investigation, but timing comes as GOP near Biden impeachment decision
Comer response: “It’s beyond parody that Democrats continue their obsession with former President Trump. Former President Trump has legitimate businesses but the Bidens do not"
Senate staff physically blocking reporters from walking and talking with senators as they leave building for the day.
A hard contrast from last week when we walked out with Collins, Alexander, etc., so we could get their thoughts
Latest example of rules being changed on a whim
Thx to whistleblowers now the world can see what ive seen & what the FBI tried to conceal Serious allegations from trusted FBI source What did the FBI do to investigate????
News: Lofgren-McClintock circulating a letter to their colleagues on joining the Fourth Amendment Caucus and briefly outlining priorities for 702 debate:
New:
Republicans are plunging into a divisive surveillance debate that has pitted two warring factions against each other for months. There’s plenty of backbiting and mistrust to go around.
A DEEP dive into the House's GOP's months-long 702 debate:
🧵
WH's Ian Sams on hearing timing re: potential shutdown: "Instead of working to avoid the pain they and their extreme House Republican colleagues could inflict on Kentuckians and Ohioans... Comer and Jordan are posing for the cameras to attack President Biden with debunked smears"
NEW:
The Jan. 6 select committee won’t personally tell the story of Trump’s bid to subvert the 2020 election. Instead, they’re letting Trump’s own aides, confidants and family members do it for them.
@kyledcheney
and I on the committee's strategy:
Hunter Biden's lawyer in a letter to Comer re-upped their offer to meet with the committee to discuss if Hunter Biden had information that "may inform some legitimate legislative purpose"
If you didn't watch the Foreign Relations' Russia hearing today, do yourself a favor and go to the 45:50 mark on this video and watch Bob Corker's reaction when they tell him Trump's trade/tariff strategy is working:
Gaetz says he will vote against rule on 702 bill unless the data broker proposal is given an amendment vote.
It’s currently not expected to get one. Leadership instead has indicated it could up as a stand-alone under suspension, which supporters think kills it in the Senate.
I will vote AGAINST the rule to proceed on the FISA bill this week unless we at least have the opportunity to get votes on the things that will fix the problems with it!
If
@SpeakerJohnson
is unwilling to fix FISA, we are left wondering what he is indeed willing to fix.
UPDATE: It's officially withdrawn, per Jayapal:
"The Congressional Progressive Caucus hereby withdraws its recent letter to the White House regarding Ukraine”
Jayapal says it was drafted months ago and "released by staff without vetting"

Interesting 702 update (👋 folks watching the Super Bowl):
-Lawmakers warning the House will go into “secret session” for part of the debate. Would be first time since 2008
-no final text/amendment deal yet but expectation is still for bill on the floor toward end of the week
Golman: Archer said approximately 20 times over 10 years, "Hunter may have put his father on the phone with any number of different people and they never once spoke about any business dealings. As he described it, it was all casual conversation"
For extra context: There was a bit of an 11th-hour push to get this moved out from under Judiciary (making it a select committee instead of a select subcommittee) which didn’t ultimately happen.
IMPORTANT: Under the proposal, Judiciary chairman Jim Jordan — not the chair of the select subcommittee — would be the one with the power to authorize subpoenas for the panel.

: If not McCarthy, who else could win near-total support of the Republican conference — and actually wants the job?
Or as one member put it: “Kevin doesn’t have the votes, but no one has more votes than Kevin.”
ICYMI: Lots of nuggets in this brief dive w/
@kyledcheney
:
House Admin recently requested (and got) access to the security footage. Aide told me the request was an extension of rules making the panel the repository for Jan. 6 cmte work
Plus this Manger detail 👇
NEW: Capitol Police chief Thomas Manger told associates that he didn't know about the McCarthy-Tucker arrangement to access Jan. 6 security footage until Monday, according to a person familiar with his comments.

Source familiar confirming that Jordan asked for Scalise’s help with speaker’s race just now in a meeting.
Scalise wouldn’t commit, per the source, adding that he isn’t being a team player.
News: Comer and MTG tell me she and Oversight staff are working to set up a congressional delegation to visit those jailed on Jan. 6. (Investigating this was a commitment she asked for last year.)
MTG would lead the trip (date TBD). Letter expected to go out this week.
Update on this:
Marshall's office says he was reading a COVID poem (that is inside the Dr. Seuss book he's holding). The poem, which they note that the senator wrote, is below:
Bacon to me on Jordan’s strategy:
“We think he wants to delay this out and keep pounding on and constituents calling and the threatening, I think he’s trying to shift people through bullying tactics”
Adds it’s not working on holdouts but could on people thinking about flipping
New:
As House Republicans rush to argue that the FBI search of Donald Trump’s home is marred by politics, they are readying a future Hunter Biden investigation designed to ensnare Joe Biden ahead of a potential reelection bid.
NEWS: Murkowski gaggles with reporters after leaving McConnell's office, says she supports his idea of delaying decision on witnesses until after start of trial
Comer admits Trump sold out the American people & violated the Constitution when serving in the White House.
Sorry, no comparison—Joe Biden, like every other President but Trump, has scrupulously followed the Emoluments Clause.
We showed you our receipts. Where are yours?
McCarthy can keep Schiff and Swalwell from Intel on his own.
But he'll need near total unity from GOP to keep Omar off/remove her from Foreign Affairs, and he's already got some Republicans signaling they won't remove Dems from committees and others skeptical.
Spartz won't support McCarthy in denying Dems committee seats "without due process." Says, “As I spoke against it on the House floor two years ago, I will not support this charade" and "McCarthy needs to stop “bread and circuses” in Congress and start governing for a change.”
Arizona Democratic Party executive board censures Sinema:
“While we take no pleasure in this announcement, the ADP Executive Board has decided to formally censure Senator Sinema as a result of her failure to do whatever it takes to ensure the health of our democracy.”
