NEW: Ivanka Trump must testify after NY appellate court rejects her bid to freeze her trial subpoena. She’s slated to take the stand next Wednesday after her father’s testimony on Monday.
Now: Justice Engoron rejects Ret. U.S. Judge Barbara Jones being added as a last-minute Trump witness , saying that an independent monitor is an arm of the court and cannot be questioned & raises possible conflict issues.
"I hereby preclude their testimony," judge rules.
Breaking: A woman who approached the bench during Donald Trump‘s fraud trial today, apparently asking to speak with Trump, was arrested and placed in a New York State courts squad car just now.
Today's final moment: Trump stands at the end of a motions hearing and the judge quickly rebukes him.
“Sir, can you please have a seat," Justice Merchan said.
Trump sits.
"Thank you,” the judge says.
New: Justice Merchan unimpressed with Trump’s late-breaking presidential immunity motion to delay the March 25 hush money trial.
Judge doesn’t rule but says they’ll have to ask for permission before firing off a motion like this again, pumping the brakes on a flurry of filings.
We've been going through the first official round of "voir dire" with 30 minute rounds of questions from the DA and Trump's attorney.
At this stage, prospective jurors have said they can be impartial. A few said their personal policy differences would not impact their fairness.
New: Justice Merchan denies Trump’s presidential immunity motion “in its entirety as untimely,” ruling Trump filed it late and the court already rejected the argument in the defense’s failed motion to dismiss the case.

Breaking: Associate Justice David Friedman temporarily lifted Justice Engoron's gag orders on Donald Trump and his attorneys in the AG's civil fraud case.
Breaking: Trump fined $5,000 for violating his gag order. Justice Engoron did *not* hold him in contempt and noted it was "first time" violation and credited Trump's attorney's arguments that it was "inadvertent."

1AD's Associate Justice Cynthia S. Kern rejected Trump's bid to halt trial while a full bench mulls constitutional challenge to Justice Merchan's gag order.
Trump had argued there was ongoing, irreparable harm to him and "the voting public" caused by restricting his speech.
ORDER: Trump’s “application for an interim stay of enforcement…& for a stay of trial, is granted solely to the extent of staying enforcement of Supreme Court's order directing the cancellation of business certificates. The interim application is denied in all other respects.”

Trump Org exec Mark Hawthorne is testifying that they have had a "very cooperative" & she hasn't said she “uncovered any fraud or irregularities.”

Context is that the judge was admonishing Trump to answer the questions directly instead of giving speeches.
Does this run afoul of admonition not to discuss testimony?
The information was filed today as part of Justice Engoron's opposition to Trump's motion to lift the gag orders. The judge argued they were necessary for the safety of this staff.
This affidavit by court security is meant to support that position.
Update! Trumps fails to halt trial BUT wins a stay, freezing Justice Engoron’s moves to dissolve his businesses.

Justice Kern DENIED Trump's bid to stay the trial while the gag order is weighed. A full appellate panel will now decide Monday (same day jury selection is set to begin) whether to delay the trial. Then, the actual merits of the gag order will be considered later in the month.

We are still waiting. What will follow is among the odd things in NY courts:
One side tells the other they're seeking emergency relief, with little notice. They show up, hoping a judge will see them. If so, they go to a little room. No steno. They argue. The judge rules.
DAY 2: Trump’s hush money trial continues today with jury selection. Yesterday, we saw about 50 people excuse themselves for bias reasons – without explanation.
We’ve got about 30 people left on that slate of prospective jurors and 9 have answered questionnaires.

Remarkable findings by Merchan:
- "The Court further finds good cause..."that there is a likelihood of bribery, jury tampering, or of physical injury or harassment of jurors."
- Trump has "an extensive history of publicly and repeatedly attacking trial jurors and grand jurors."
Trump atty Chris Kise just denied he was called "rude" at the sidebar in a quick chat in the hallway just now.
...But I know it happened, because I heard it myself. And so did a bunch of other reporters in the gallery.
Now: During a 20-min. sidebar, it’s impossible to hear everything that is being said, but then:
“Be more respectful,” AG atty Colleen Faherty says to Kise.
“No,” Kise snaps back.
“That was rude,” Faherty replies, her voice confrontational.

Justice Engoron, as a matter of law, already canceled all of Trump’s business certificates.
Does NY need to reinstate them?
Well, no. Why?
The NY Dept. of State appears to have ignored the court’s order and failed to act. DOS has refused to say why…
The official Trump criminal case file is purely paper – as it is for all NYC defendants – even though emails and PDFs fly back and forth behind the scenes, what ultimately matters is an often piecemeal record with only the papers the judge sends to the clerk.
NEW: Ivanka Trump must testify in AG's fraud trial in person, Justice Engoron rules.
Despite being dismissed from the case, the judge finds she conducted business and owns property in NY and failed to submit evidence to rebut that.
She can appeal and won't testify before Nov. 1
