Another snippet from DK-Butterfly's appeal highlighting the absurdity of the HBC case getting dismissed for "failure to state a claim." District Court's logic: Man agrees not to steal. Man steals. Judge sees man agreed not to steal. Therefore, no stealing happened. Case denied.

What I find the most odd is that the District Court was actually rejecting HBC's main arguments, correctly identified that Levy is applicable here, but then rules against DK-Butterfly in favor of HBC.
