The injunction would have kicked off an administrative process that could take over two years to resolve—apparently too long for the nonprofit health system. This is despite a lower court and at least one of the appellate court's judges landing on the side of Novant Health.

A 3-2 vote is apparents as newly appointed commissioners Holyoak and Ferguson, both Republicans, will be dissenting. Each said in comments that they're sympathetic, but believe that Congress should be making the momentous call rather than an administrative agency.

Final rule does not extend to healthcare nonprofits (i.e. many health systems) due to FTC's limited authority . though Commissioner Slaughter said in comments she sees no reason why noncompetes on nonprofit orgs wouldn't bring benefits to workers and consumers.

Per a staffer's presentation to the commissioners, it appears the final rule will be wiping noncompetes going forward and unwinding those that exist, with the exception of "senior executives.".
